What is happening?
HIGHWAYS ACT 1980 AND WILDLIFE AND COUNTRYSIDE ACT 1981
CUMBERLAND COUNCIL (FOOTPATH NO 132015 PARISH OF STANWIX RURAL) PUBLIC PATH DIVERSION AND DEFINITIVE MAP AND STATEMENT MODIFICATION ORDER 2024
On the 17 December 2024 Cumberland Council confirmed the above order made under Section 119 of the Highways Act 1980 and Section 53 of the Wildlife and Countryside Act 1981.
The effect of the order as confirmed is to divert the whole width of that length of public footpath no 132015 at Houghton House in the parish of Stanwix Rural from grid reference 340859 560900 westwards for about 195 metres to grid reference 340672 560928; to run from grid reference 340859 560900 about 250 metres north-northwestwards turning southwestwards along a track to grid reference 340672 560928. The width of the new path will vary between 3.5 metres and 5.3 metres.
A copy of the confirmed Order and map may be inspected free of charge at the offices of the Countryside Access Team, The Parkhouse Building, Kingmoor Business Park, Carlisle CA6 4SJ by appointment only (ref 5.1.376). Details of the Order are available to view on the Council’s website and copies of the Order may be purchased at a cost of £2 per A4 sheet and £3 per A3 sheet. The order comes into force on 20 December 2024, but if a person aggrieved by the order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within 6 weeks from 20 December 2024 make an application to the High Court.
