(EXPERIMENTAL PART-TIME PROHIBITION OF
DRIVING RESTRICTIONS) (EXTENSION) ORDER 2024
The East Dunbartonshire Council made the East Dunbartonshire Council (Park Road, Bishopbriggs; Craigielea Crescent and Kirk Street, Milngavie; Craighead Avenue, Craighead Road and School Lane, Milton of Campsie) (Experimental Part-Time Prohibition of Driving Restrictions) Order 2023 (“the Order”) on 07 November 2023 in exercise of the powers conferred on them by Sections 9 and 10 of the Road Traffic Regulation Act 1984 and of all other enabling powers and after consultation with the Chief Officer of Police in Scotland in accordance with Part III of Schedule 9 to said Act and having complied with the statutory requirements of The Local Authorities’ Traffic Orders (Procedure) (Scotland) Regulations 1999. The Order is experimental and is initially in operation until 20 December 2024.
The effect of the Order, which came into operation on 20 November 2023, is to introduce a part-time prohibition of driving on lengths of road in the vicinity of Clober Primary School, Craighead Primary School, St Matthew’s Primary School and Wester Cleddens Primary School in the interests of road safety and traffic management.
The Council has now on 2 December 2024 made a further Order, the East Dunbartonshire Council (Park Road, Bishopbriggs; Craigielea Crescent and Kirk Street, Milngavie; Craighead Avenue, Craighead Road and School Lane, Milton of Campsie) (Experimental Part-Time Prohibition of Driving Restrictions) (Extension) Order 2024 (“the Extension Order”) to extend the duration of the Order until 19 May 2025. The reason for making the Extension Order is that during the period of the Extension Order the Council will consider whether the provisions of the Order, currently experimental, should be made permanent.
A copy of the Order and the Extension Order as made, together with a map showing said lengths of road and a Statement of the Council’s Reasons for making the Order are available for inspection without payment of fee in the Roads section of the East Dunbartonshire Council website. Any person wishing to question the validity of the Extension Order or of any of its provisions on the grounds that it is not within the powers of the relevant enabling Act or that a requirement of any such enabling Act or of any relevant regulations made thereunder has not been complied with may, within 6 weeks from 02 December 2024, make an application for that purpose to the Court of Session. East Dunbartonshire Council will be considering in due course whether the provisions of the Order should be continued in force indefinitely.
