Notice of Confirmation of Modification Order SECTION 53 OF THE WILDLIFE AND COUNTRYSIDE ACT 1981 STAFFORDSHIRE COUNTY COUNCIL DEFINITIVE MAP AND STATEMENT FOR THE BOROUGH OF NEWCASTLE-UNDER-LYME

Staffordshire County Council (REGRADING TO BRIDLEWAY OF PUBLIC FOOTPATHS NO.68 MADELEY PARISH AND NO.24 WHITMORE PARISH, STAFFORDSHIRE, Modification Order 2022

On the 16th August 2024, the Secretary of State for Environment, Food and Rural Affairs confirmed the above Order without modification. The effect of the Order, as confirmed, is to modify the Definitive Map and Statement for the area by reclassifying the entire length of Public Footpath 68, Madeley Parish to a public bridleway, commencing at point A on the map (NGR 379276 343883) at the eastern end of public right of way no.67 Madeley Parish approximately 120 metres east north-east of Higher Stoneylow House. Proceeding in a generally east southeasterly direction for approximately 270 metres, then in a generally easterly direction for approximately 280 metres to its terminus at the parish boundary coincidental with the western terminus of public right of way no. 24, Whitmore Parish – point B on the map (NGR 379817 343798) and the reclassification of the entire length of footpath no.24 Whitmore Parish to a public bridleway, commencing at point B on the map (NGR 379817 343798) at the parish boundary coincidental with the eastern end of public right of way no.68, Madeley Parish. Proceeding in a generally eastern direction for approximately 230 metres, then in a generally east north-easterly direction for approximately 420 metres to its terminus on the western side of the public highway known as Three Mile Lane opposite The Gables – point C on the map (NGR 380457 343908). A copy of the confirmed Order and the Order Map has been deposited and may be seen free of charge at the offices of Newcastleunder-Lyme Borough Council, Castle House, Barracks Road, Newcastle-under-Lyme, Staffordshire ST5 1BL and at Staffordshire County Council Reception, Staffordshire Place 1, Tipping Street, Stafford, ST16 2DH during normal working hours, Mondays to Fridays. 

Copies of the Order and Map may be purchased. The Order came into force on the 16th August 2024 but if a person aggrieved by the Order wishes to question its validity or any provision contained within it on the ground that it is not within the powers of the Wildlife and Countryside Act 1981 or on the ground that any requirement of the Act or of any Regulation made under the Act has not been complied with in relation to the Order, they may, under paragraph 12 of Schedule 15 to the Act within 42 days from the date of the publication of this Notice make an application to the High Court.
