HIGHWAYS ACT 1980 WILDLIFE AND COUNTRYSIDE ACT 1981

HAMPSHIRE COUNTY COUNCIL

THE HAMPSHIRE (WINCHESTER CITY NO.68) (PARISH OF WICKHAM) AND (FAREHAM BOROUGH NO.10) PUBLIC PATH CREATION AND DEFINITIVE MAP AND STATEMENT MODIFICATION ORDER 2024 AND

THE HAMPSHIRE (WINCHESTER CITY NO.69) (PARISH OF WICKHAM - PART OF FOOTPATH 23B) (FAREHAM BOROUGH NO.11) (PART OF FOOTPATH 86 AND 88)

PUBLIC PATH EXTINGUISHMENT AND DEFINITIVE MAP MODIFICATION ORDER 2024

IMPORTANT - THIS COMMUNICATION AFFECTS YOUR PROPERTY

On 24 October 2024 Hampshire County Council confirmed the above Order made under sections 26 and 118 of the Highways Act 1980. The effect of the Order as confirmed is to:

  • Create a public bridleway commencing at a junction with Funtley Hill that proceeds in an easterly direction for approximately 65 metres, continuing in a northerly direction to a junction with Wickham Footpath 23b;
  • Create a public footpath commencing at a junction with Wickham Footpath 15 that proceeds in an easterly direction to join the above-mentioned bridleway to be created;
  • Create a public footpath linking the above-mentioned bridleway to be created to Fareham Footpath 86 at Funtley Hill; and
  • Extinguish that part of Fareham Footpath 86 that commences at a junction approximately 142 metres north of Funtley Hill and proceeds northwards to a point near the junction of Wickham Footpaths 23a and 23b
  • Extinguish a short section of Fareham Footpath 88, approximately 24 metres in length, that runs between the current line of Fareham Footpath 86 and the above?mentioned bridleway that is to be created.

A copy of the Order and the Order map have been placed and may be seen free of charge at the offices of Hampshire County Council, The Castle, Winchester, SO23 8UJ, and at the offices of Winchester City Council, City Offices, Colebrook Street, Winchester, SO23 9LJ and at Fareham Borough Council, Civic Offices, Civic Way, Hampshire, PO16 7AZ at all reasonable hours; and online at www.hants.gov.uk/publicnotices. The Order came into force on 24 October 2024, but if any person aggrieved by the Order wants to question its validity, or any provision contained in it, on the grounds that it is not within the powers of the Highways Act 1980, as amended, or on the grounds that any requirement of the Act, as amended, or any regulation made under the Act has not been complied with in relation to the Order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within six weeks from 08 November 2024 make an application to the High Court.
