1. NOTICE IS HEREBY GIVEN that the Council of the London Borough of Brent on 21 st October 2024 made the above-mentioned Orders under sections 9 and 10 of the Road Traffic Regulation Act 1984, as amended by section 8 of and Part 1 of Schedule 5 to the Local Government Act 1985.
2. The general effect of the Orders will be to:-
a) prohibit any vehicle to enter that length of Okehampton Road, which lies between the north-eastern kerb-line of Chamberlayne Road and a point opposite the party wall of Nos. 4 and 6 Okehampton Road - between 8.30 a.m. to 9.30 a.m. and 2.30 p.m. to 3.30 p.m. on Mondays to Fridays inclusive (school term time only);
b) introduce two parking places specified in Schedule 1 to this notice inside the proposed school zone, generally located opposite No. 2 and opposite No. 5 Park Parade, Okehampton Road to operate as bus parking places between 8.30 a.m. to 9.30 a.m. and 2.30 p.m. to 3.30 p.m. on Mondays to Fridays and to also operate as zone 'KS' permit holders only parking places between 9.30 a.m. and 2.30 p.m. on Mondays to Fridays;
c) specify that for the permit holders only parking place:-
(i) each parking place may be used, subject to the provisions of the Order, for the leaving during the permitted hours of such vehicles as are passenger vehicles, goods carrying vehicles, motorcycles or invalid carriages for which a valid parking permit has been issued by the Council. Motorcycles park free;
(ii) any resident whose usual place of abode is in any street specified in Schedule 2 to this Notice may apply to the Council for the issue of a residents permit valid for use in the parking places, a £100 per annum surcharge would apply for the grant or issue of new or renewed residents' permits in respect of diesel vehicles;
(iii) a maximum of 3 permits per residential postal address would be issued by the Council or its agents, to persons whose usual place of abode is in any street specified in Schedule 2 to this Notice. The charge would be based on a carbon dioxide emissions based sliding charge for passenger vehicles registered on or after 1st March 2001 and on engine size based sliding charge for passenger vehicles registered before 1 st March 2001 and qualifying goods carrying vehicles, as specified in Schedule 3 to this Notice. Fully electric vehicles would fall under Band 1;
(iv) car club cars displaying a car club all zone permit would be permitted to park in any permit parking place;
(v) any resident whose usual place of abode is in any street specified in Schedule 2 to this Notice may apply to the Council for the issue of a household visitor permit valid for use in the street for which it is issued for the period between 9.30 a.m. and 2.30 p.m. on Mondays to Fridays inclusive. The charge would be based on a carbon dioxide emission based sliding charge for passenger vehicles registered on or after 1st March 2001 and on engine size based sliding charge for passenger vehicles registered before 1 st March 2001 and qualifying goods carrying vehicles, as specified in Schedule 4 to this Notice;
(vi) any resident whose usual place of abode is in any street specified in Schedule 2 to this Notice may apply to the Council for the issue of visitor's e-permits valid for the period between 9.30 a.m. and 2.30 p.m. on Mondays to Fridays inclusive, at a cost of £1.75 per visitor's e-permit for a parking period of up to 2 hours on the day of use during permitted hours, £3.50 per visitor's e-permit for a parking period of up to 4 hours on the day of use during permitted hours. No refunds would be made;
(vii) any person who occupies premises in any street specified in Schedule 2 to this Notice and who uses such premises for non-residential purposes may apply to the Council for the issue of a general business permit valid for use in the parking places specified in Schedule 1 to this notice between 9.30 a.m. and 2.30 p.m. on Mondays to Fridays inclusive (Maximum 3 Permits). The charge for each general business permit would be £593 per annum (£357 for 6 months, £237 for 3 months);
(viii) any person who occupies premises in any street specified in Schedule 2 to this Notice and who uses such premises for non-residential purposes may apply to the Council for the issue of a business address permit granted
or issued so as to be transferable between multiple vehicles used by one business user in the parking places specified in Schedule 1 to this notice between 9.30 a.m. and 2.30 p.m. on Mondays to Fridays inclusive. The charge for each business permit would be £723 per annum (£434 for 6 months, £290 for 3 months);
(ix) permits issued by the Council to essential users would be valid for use in all the parking bays provided for resident and business users in the KS zone. The charge for an essential user permit issued in respect of a vehicle used by a person employed by either the NHS, a care organisation recognised by the Council or a registered charity would be £445 per annum, and the charge for an essential user permit issued in respect of a vehicle used by any person would be £593 per annum;
(x) any resident of a "car free' development as defined in a section 106 agreement made under the Town and Country Planning Act 1990 would not be eligible for a residents' permits in the KS zone;
(xi) any school who occupies premises any street specified in Schedule 2 to this Notice and who uses such premises for non-residential purposes may apply to the Council for the issue of a school permit in respect of a vehicle used by a person employed by the school would be £445 per annum running from the beginning of the month in which a permit becomes first valid, provided that a school permit shall only be deemed valid during an academic term.
d) remove both 'at any time' waiting and loading restrictions indicated by double yellow lines and double kerb blips respectively, generally located opposite No. 2 and opposite No. 5 Park Parade, Okehampton Road to accommodate the introduction of the proposed parking places stated in Schedule 1 to this Notice;
e) change the operational hours of the existing shared-use parking places in Crediton Road generally located between opposite No. 51 and opposite the side of Crediton Heights from 'between 9.30 a.m. to 2.30 p.m. and 4.00 p.m. to 6.30 p.m. on Mondays to Fridays' to 'between 9.30 a.m. to 2.30 p.m. and 3.30 p.m. to 6.30 p.m. on Mondays to Fridays';
f) change the operational hours of the existing bus parking places in Crediton Road generally located between opposite No. 51 and opposite the side of Crediton Heights from 'between 8.00 a.m. to 9.30 a.m. and 2.30 p.m. to 4.00 p.m. on Mondays to Fridays' to 'between 8.30 a.m. to 9.30 a.m. and 2.30 p.m. to 3.30 p.m. on Mondays to Fridays';
g) change the operational hours of the existing bus parking places in Okehampton Road generally located outside No. 8 and opposite No. 6 Park Parade from 'between 8.00 a.m. to 9.30 a.m. and 2.30 p.m. to 4.00 p.m. on Mondays to Fridays' to 'between 8.30 a.m. to 9.30 a.m. and 2.30 p.m. to 3.30 p.m. on Mondays to Fridays'.
3. The prohibition referred to in paragraph 2(a) above will not apply to:
(a) a pedal cycle; or
(b) a valid SZ 34 permit; or
(c) any vehicle when used for fire brigade, ambulance or police purposes; or
(d) a valid blue badge holder residing in the prescribed street; or
(e) any person causing any goods vehicle to enter the prescribed street for the purpose of loading or unloading in the prescribed street; or
(f) any person causing any vehicle to enter the prescribed street for the purpose of gaining access to off-street garaging accessible only from the prescribed street; or
(g) any vehicle being used in connection with the maintenance, improvement,
reconstruction, cleansing or lighting of the prescribed street or any street accessible only therefrom, or the laying, erection, alteration or repair of any sewer thereunder or of any main, pipe or apparatus for the supply of gas, water or electricity or of any electronic communications network thereunder or thereon, or the placing, maintenance or removal of any traffic sign thereon; or
(h) anything done with the permission or at the direction of a police constable in uniform; or
(i) any vehicle when used in the service of a local authority in pursuance of statutory powers or duties provided that in all the circumstances it is reasonably necessary in the exercise of such duties for that vehicle to enter and proceed in the road referred to in paragraph 2(a) during the prescribed hours; or
(j) any resident residing in the prescribed street or a visitor visiting a resident in the
prescribed street; or
(k) a carer assisting a resident residing in the prescribed street; or
(I) a hackney carriage; or
(m) any vehicle used for the purposes of school transport and taxi card transport services; or
(n) any vehicle when used for the purposes of transporting residents who reside in the
prescribed street for medical appointments; or
(o) any vehicle when used for the purposes of Dial-a-Ride services to aid residents who
reside in the prescribed street; or
(p) Royal Mail vehicles used for delivery purposes; or
(q) any vehicle used by a medical practitioner or healthcare worker to attend to a
resident residing in the prescribed street; or
(r) any person who causes any vehicle to proceed in accordance with any restriction or requirement indicated by traffic signs placed pursuant to section 66 or 67 of the Road Traffic Regulation Act 1984.
4. Copies of the Orders, which will come into force on 1 st November 2024 and may remain in force for up to 18 months of maps of the relevant areas (and of any related Order) can be inspected during normal office hours on Mondays to Fridays inclusive until the Orders cease to have effect, at Brent Customer Services, Brent Civic Centre, Engineers Way, Wembley, Middlesex, HA9 0FJ. 5. Any person desiring to question the validity of the Orders or of any provision contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984 or that any of the relevant requirements thereof or of any relevant regulations made thereunder has not been complied with in relation to the Orders may, within six weeks of the date on which the Orders were made, make application for the purpose to the High Court.
6. Where it appears necessary for certain purposes, the Council's Head of Healthy Streets and Parking or any person authorised in that behalf by him may modify or suspend the orders or any of its provisions, while the Orders are in force.
7. The Council of the London Borough of Brent will consider in due course whether the provisions of the experimental Orders should be continued in force indefinitely by means of an Order made under sections 6, 45, 46, 49 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984. Any person may object to the making of the permanent Orders for the purpose of such indefinite continuation, within a period of six months beginning with the date on which the experimental Orders come into force or, if the Orders are varied by other Orders or modified pursuant to section 10(2) of the 1984 Act, beginning with the date on which the variation or modification or the latest variation or modification comes into force. Any such objection must be made in writing and must state the grounds on which it is made and be sent to Head of Healthy Streets and Parking, Healthy Streets and Parking Service, 6th Floor West Wing, Brent Civic Centre, Engineers Way, Wembley, Middlesex, HA9 0FJ or by email to trafficorders@brent.gov.uk, quoting reference TO/30/047/NP.
