THE KENT COUNTY COUNCIL (PUBLIC FOOTPATH EE262 EASTRY) PUBLIC PATH EXTINGUISHMENT AND DEFINITIVE MAP AND STATEMENT MODIFICATION ORDER 2024

On the 8th day of October 2024, the County Council confirmed the above-named Order. The effect of the Order as confirmed, will be to extinguish the entire width of that length of Public Footpath numbered EE262 at Eastry, commencing from its junction with Thornden Road and Thornden Lane at NGR TR 2883 5232 (Point A) and running in a north-westerly direction for 291 metres to its junction at Shingleton Farm at NGR TR2871 5258 (Point B), as shown between the points A and B on the Order Plan.

All distances are approximate, all directions are general.

The Order came into force on the 8th day of October 2024, but if a person aggrieved by the Order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act which has not been complied with in relation to the Orders, he or she may under Paragraph 2 of Schedule 2 to the Act as applied by Paragraph 5 of Schedule 6 to the Act, within 6 weeks from the 5l 2024, make an application to the High Court.

NOTICE OF MODIFICATION ORDER

WILDLIFE AND COUNTRYSIDE ACT 1981

DEFINITIVE MAP AND STATEMENT FOR THE COUNTY OF KENT

THE KENT COUNTY COUNCIL(RESTRICTED BYWAY HE375, ELHAM)DEFINITIVE MAP MODIFICATION ORDER 2024

The above Order was made on the 4th September 2024 under section 53 of the Wildlife and Countryside Act 1981. If confirmed, it will modify the Definitive Map and Statement for the area by adding a restricted byway numbered HE375, with a width of 4.0 metres, which (a) commences on Cullens Farm Road at NGR TR 1619 4335 (Point A on the order plan) and runs in a southeasterly, southernly and then south-easterly direction for 313 metres to NGR TR 1637 4310 (Point B) and (b) commences at NGR TR 1646 4306 (Point C) and runs in a southeasterly direction for 423 metres to its connection with Mill Hill at NGR TR 1678 4279 (Point D).and changing the status of the section of recorded Public Footpath HE100, which runs from the aforementioned Point B and runs in a south-easterly direction for 96 metres to the aforementioned Point C, to a restricted byway numbered HE375 with a width of 4.0 metres.

Any representation about or objection to the Order must be sent or delivered in writing to William Barfoot at the Kent County Council (PROW and Access, 1st Floor, Invicta House, Maidstone, Kent, ME14 1XX) (email: william.barfoot@kent.gov.uk ) (Tel: 03000 418674 ) no later than 6th December 2024. Please state the grounds on which they are made.

Please note that objections/representations cannot be treated as confidential and may come into the public domain. Copies of any objections or representations received may be disclosed to interested parties, including the Planning Inspectorate where the case is referred to it for determination.

If no such representations or objections are duly made to the Order (or to any part of it), or if any so made are withdrawn, the Kent County Council, instead of submitting the Order to the Secretary of State (or part of it if the Authority has by Notice to the Secretary of State so elected under paragraph 5 of schedule 15 to the Wildlife and Countryside Act 1981) may itself confirm the Order (or that part of the Order). If the Order is sent to the Secretary of State for the Environment (in whole or in part), any representations or objections which have been duly made and not been withdrawn will be sent with it.
