Ar 15fed Hydref 2024, cadarnhaodd Cyngor Sir Fynwy heb addasiadau y Gorchymyn a enwir uchod a wnaed o dan Adran 119 o Ddeddf Priffyrdd 1980.
Roedd y gorchymyn uchod, a wnaed ar 6ed Awst 2024, o dan adran 119 o Ddeddf Priffyrdd 1980 yn dargyfeirio’r llwybr troed a ganlyn: Llwybr Troed 169 o bwynt A (SO4915508320) i gyfeiriad y De Ddwyrain am bellter o 200m yn gyntaf ar hyd y llwybr mynediad i gerbydau ac yna o’r blaen o'r prif adeilad tŷ i bwynt F (SO4930508192) i linell sy'n mynd o A i gyfeiriad De-Ddwyrain am 23m i Bwynt B (SO491660830), o B De Ddwyrain am 34m i bwynt C (SO4919208280) ar drac heb ei wneud, o C De-Ddwyrain am 21m i bwynt D(SO4920808268), o D, gadael y trac, De-Ddwyrain am 101m dros lawnt i bwynt E (SO4927408196), o’r Dwyrain Dwyrain i ailymuno â’r llwybr troed nad yw wedi’i effeithio ym mhwynt F (SO4930508192) fel y dangosir ar map y drefn.
Ar ôl arolygiad ar 6ed Awst 2024, canfu'r Awdurdod y cydymffurfiwyd â darpariaethau Rhan 2 a 3 o'r Atodlen i'r Gorchymyn yn yr ystyr bod y llwybrau troed wedi'u creu a'r celfi wedi'u gosod i foddhad rhesymol yr Awdurdod. Mae'r awdurdod drwy hyn yn tystio bod creu'r llwybr troed wedi dod i rym o'r dyddiad hwnnw.

Rhaid i unrhyw berson sy’n dymuno hawlio iawndal o dan A28, fel y’i cymhwysir gan A121(2) o Ddeddf 1980 am ddibrisiant neu ddifrod oherwydd aflonyddwch o ganlyniad i’r Gorchymyn ddod i rym, wneud ei hawliad yn ysgrifenedig wedi’i gyfeirio at y Prif Swyddog - Y Gyfraith. a Llywodraethu, Neuadd y Sir, Y Rhadyr, Brynbuga, NP15 1GA a’i gyflwyno drwy ei ddanfon yn y cyfeiriad uchod, neu ei anfon drwy’r post rhagdaledig i’r cyfeiriad uchod o fewn chwe mis i’r Gorchymyn ddod i rym. Daw'r Gorchymyn i rym ar 17eg Hydref 2024. Os yw person a dramgwyddir gan y Gorchymyn yn dymuno cwestiynu ei ddilysrwydd, neu ddilysrwydd unrhyw ddarpariaeth a gynhwysir ynddo, ar y sail nad yw o fewn pwerau Deddf Priffyrdd 1980, fel y’i diwygiwyd, neu ar y sail na chydymffurfiwyd ag unrhyw un o ofynion y Ddeddf, fel y’i diwygiwyd, neu unrhyw reoliad a wnaed o dan y Ddeddf mewn perthynas â’r Gorchymyn, caiff, o dan baragraff 2 o Atodlen 2 i’r Ddeddf fel y’i cymhwysir. gan baragraff 5 o Atodlen 6 i’r Ddeddf, o fewn chwe wythnos i ddyddiad yr hysbysiad hwn, wneud cais i’r Uchel Lys.

Notice Of Confirmation Of A Public Path Order Section 119 - Highways Act 1980

Monmouthshire County Council: Public Footpath No. 169
(Part) Mitchel Troy Order 2024
On the 15th October 2024 Monmouthshire County Council confirmed without modifications the above-named order made under Section 119 of the Highways Act 1980.
The above order, made on 6th August 2024, under section 119 of the Highways Act 1980 diverted the following footpath: Footpath 169 from point A (SO4915508320) in a South Easterly direction for a distance of 200m first along the vehicular access route then in front of the main house building to point F (SO4930508192) to a line running from A in a South South Easterly direction for 23m to Point B(SO491660830), from B South Easterly for 34m to point C (SO4919208280) at an unmade track, from C South Easterly for 21m to point D(SO4920808268), from D, leaving the track, South Easterly for 101m over a lawn to point E (SO4927408196), from E Easterly to rejoin the unaffected footpath at point F (SO4930508192) as shown on the order map.
After inspection on 6th August 2024, the Authority found that the provisions of Part 2 and 3 of the schedule to the order had been complied with in that the footpaths been created and furniture put in place to the reasonable satisfaction of the Authority. The authority hereby certifies that the creation of the footpath took effect from that date.
A copy of the Orders as confirmed and the maps contained in them have been placed and may be inspected free of charge at The Monmouth Community Hub, Rolls Hall, Whitecross St, Monmouth NP25 3BY, opening hours Monday 8:45am – 1pm and 2pm - 5pm, Tuesday 8:45am – 1pm and 2pm - 6pm, Wednesday 8:45am –1pm and 2pm - 5pm,Thursday Closed, Friday 8:45am – 1pm and 2pm - 5.00pm Saturday 9am-1pm. Copies of the Order and map are available free of charge.. Alternatively the documents may be found at http://www.monmouthshire.gov.uk/?p=48611 or email CountrySide@monmouthshire.gov.uk Any person who wishes to claim compensation under S28, as applied by S121(2) of the 1980 Act for depreciation or damage for disturbance in consequence of the coming into operation of the Order must make his claim in writing addressed to the Chief Officer - Law & Governance, County Hall, The Rhadyr, Usk, NP15 1GA and serve it by delivering it at, or sending it by pre-paid post to the above address within six months of the Order coming into effect.
The Order will come into force on the 17th October 2024. If a person aggrieved by the Order desires to question their validity, or that of any provision contained in them, on the grounds that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the Order, he may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within six weeks from the date of this notice, make an application to the High Court.
