THE BRENT (WAITING AND LOADING RESTRICTION) (AMENDMENT NO. 641) ORDER 2024, THE BRENT (GOODS VEHICLES) (FREE LOADING PLACES) (NO. 5) ORDER 2024, THE BRENT (PARKING PLACES) (ZONE C) (NO. 5) ORDER 2024, THE BRENT (PARKING PLACES) (ZONE E) (NO. 2) ORDER 2024, THE BRENT (PARKING PLACES) (ZONE GH) (NO. 4) ORDER 2024, THE BRENT (PARKING PLACES) (NO. 2, 2013) (AMENDMENT NO. 1) ORDER 2024

1. NOTICE IS HEREBY GIVEN that the Council of the London Borough of Brent on 7th October 2024 made the above-mentioned Orders under sections 6, 45, 46, 49 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984, as amended by section 8 of and Part 1 of Schedule 5 to the Local Government Act 1985, the Parking Acts of 1986 and 1989 and the Traffic Management Act 2004.

2. The general effect of the 'Waiting and Loading Restriction' Order will be further to amend the Brent (Waiting and Loading Restriction) Order 1979, so that:-

(a) waiting by vehicles (otherwise than for the purpose of delivering or collecting goods or loading or unloading a vehicle) will be prohibited at any time in the lengths of streets specified in Schedule 1 to this Notice, except for motorcycles in the motorcycle parking areas specified in Schedule 2 to this notice;

(b) the sale or offer for sale of goods from a vehicle will be prohibited (except on Sundays) in the lengths of streets specified in Schedule 1 to this Notice, unless there is in force a valid licence issued by the Brent Borough Council or the goods are immediately taken into or delivered at premises adjacent to the vehicle from which the sale is effected;

(c) the use of any vehicle or of any animal or the wearing of fancy dress or other costume, wholly or mainly for the purpose of advertising will be prohibited in the lengths of streets specified in Schedule 1 to this Notice;

(d) any existing prohibition on the waiting by vehicles, the sale or offer for sale of goods from a vehicle or the use of any vehicle or animal or the wearing of fancy dress or other costume wholly or mainly for the purpose of advertising in the lengths of streets specified in Schedule 1 to this Notice will be revoked;

(e) to make minor drafting amendments to the existing restrictions to conform with the current on-site layout.

3. The prohibitions referred to in sub-paragraphs 2(a) above will not apply in respect of anything done with the permission or at the direction of a police constable in uniform or in certain circumstances, e.g., the picking up or setting down of passengers; the carrying out of statutory powers or duties; the taking in of petrol, etc., from roadside petrol stations; to licensed street traders, etc. The usual exemption relating to vehicles displaying a disabled person's "Blue Badge" will apply.

4. The general effect of the 'Goods Vehicles Free Loading Places' Order will be to:-

(a) introduce a goods vehicles free loading place in Eagle Road, as specified in Schedule 3 to this Notice;

(b) provide that the goods vehicle free loading place referred to in sub­paragraph 4(a) above will operate between 10.00 a.m. and 4.00 p.m., Monday to Sunday; and

(c) specify that goods carrying vehicles constructed or adapted for use for the carriage of goods or burden of any description and is not drawing a trailer, may use the parking place so specified in Schedule 3, subject to the provisions of the Order, for the purpose of continuous loading and unloading during the permitted hours.

5. The general effect of the 'Parking Places' Orders will be to introduce permit holders only parking places in a certain length of road specified in Schedule 4 to this Notice and to reduce in length existing parking places to accommodate the introduction of solo motorcycle and free loading parking places.

6. Copies of the made Orders, which will come into force on 21 st October 2024, and of the relevant Orders of 1979, 2013 and 2019 (and of any Orders which have amended those Orders), and of maps which indicate each length of road to which the Orders relate can be inspected during normal office hours on Mondays to Fridays inclusive until the end of a period of 6 weeks from the date on which the Orders were made at Brent Customer Services, Brent Civic Centre, Engineers Way, Wembley, Middlesex, HA9 0FJ.

7. Copies of the Orders may be purchased from the address mentioned in paragraph 4 above.

8. Any person desiring to question the validity of the Orders or of any provision contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984 or that any of the relevant requirements thereof or of any relevant regulations made thereunder has not been complied with in relation to the Orders may, within six weeks of the date on which the Orders were made, make application for the purpose to the High Court.

SCHEDULE 1

Waiting restrictions (At any time)

(a) Ealing Road, the south-west side, between 3 metres south-east of Nos. 162 and 164 Ealing Road and 6 metres north-west of Nos. 162 and 164 Ealing Road;

(b) Elgar Avenue

(i) the east, north-east and south-east sides, between 5.5 metres north­west of Mitchellbrook Way and its northernmost extremity;

(ii) the west, north-west and south-west sides, between 0.5 metre north­west of the south-eastern boundary of No. 12 Mitchellbrook Way and its northernmost extremity;

(c) Mitchellbrook Way

(i) the north-west side, between 10 metres north-east of Elgar Avenue and 10 metres south-west of the western building wall of No. 52 Mitchellbrook Way;

(ii) the north-west side, between 8 metres north-east of Nos. 50 and 51 Mitchellbrook Way and 10.5 metres north-east of the western building wall of Nos. 16 to 24 Mandarin Court, Mitchellbrook Way;

(iii) the south-east side, between 2.5 metres north-east of the western building wall of Nos. 16 to 24 Mandarin Court, Mitchellbrook Way and 10.5 metres north-east of that building wall.

SCHEDULE 2

Solo motorcycle parking area (At any time)

(a) Harrow Road, Wembley, north-east side, from 2.8 metres north-west of the south-eastern boundary of No. 794 Harrow Road, Wembley, north­westward for 6.5 metres;

(b) London Road, the north-east side, from 1.5 metres north-west of Nos. 1 and 2 to 3 Sevenex Parade, London Road, north-westward for 5 metres.

SCHEDULE 3

Free goods vehicle loading places (10.00 a.m. and 4.00 p.m. Monday to Sunday - loading / unloading limited to 30 minutes, no return for 2 hours)

Eagle Road, the south-east side, from 8 metres south-west of Ealing Road, south-westward for 10 metres.

SCHEDULE 4

Permit holders only parking places (8.30 a.m. and 6.30 p.m. Monday to Friday)

Harlesden Road, the north-west side, from 14 metres north-east of Parkfield Road, north-eastward for 16 metres.
