What is happening?
NOTICE OF CONFIRMATION OF AN ORDER HIGHWAYS ACT 1980
WILDLIFE AND COUNTRYSIDE ACT 1981
DEVON COUNTY COUNCIL
(FOOTPATH NO.19, MARLDON ) PUBLIC PATH DIVERSION AND DEFINITIVE MAP AND STATEMENT MODIFICATION ORDER 2024
The above order confirmed on 2nd September 2024 under Section 119 of the Highways Act 1980 and Section 53A(2) of the Wildlife and Countryside Act 1981, will divert public Footpath No.19, Marldon running from the current line Point A on the Torbay Unitary Authority boundary through grazing paddocks to Point B, to a new line from Point A, through a field to Point C, continuing between paddocks to Point D.
The path continues in a north-northeasterly direction to Point E then onto a track and turns generally north northwest to Point F then to Point G and its junction with the C11 Totnes Road as shown on the order map CCET/PROW/23/095. A copy of the confirmed order and the order map have been placed with South Hams District Council, Follaton House, Plymouth Road, Totnes or can be viewed and downloaded at www. devon.gov.uk/haveyoursay Copies of the order and map may be bought from the address below at the price of £5.00.
The order came into force on 1st October 2024 but if a person aggrieved by the order wants to question its validity, or that of any provision contained in it on the ground that it is not within the powers of the Highways Act 1980 as amended, or on the ground that any requirement of the Act as amended or of any regulation made under the Act has not been complied with in relation to the order, they may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within 6 weeks from the date of this notice, make an application to the High Court.
