What is happening?

LEICESTER CITY COUNCIL (WOODGATE AREA, LEICESTER) (RESIDENTS PARKING SCHEME) (AMENDMENT No.###) ORDER 2024 (TMP2998)

NOTICE IS HEREBY GIVEN that The Leicester City Council PROPOSES TO MAKE an Order under Sections 1, 2, 32, 35, 49, 51 53, 63A and Part IV of Schedule 9 of the Road Traffic Regulation Act, 1984, and after consultation with the Chief Officer of Police in accordance with Part III of Schedule 9 to the 1984 Act, and by the virtue of section 74 of the Traffic Management Act 2004 (“the 2004 Act”) as amended and all other enabling powers, in respect of roads in the City of Leicester being a Civil Enforcement Area (CEA). The effects of the Order are set out in Schedule 1 to this Notice. Listed within Schedule 2 to this Notice, will identify new Restriction types to be added to the Order Articles.

Schedule 1

The effects of the proposed Traffic Regulation Order will be: -

• To provide a Residents permit parking only past this point (except in signed bays), Residents’ Zone ‘M’ operating all hours on all days on the following roads: Bassett Street; Balfour Street; Bonchurch Street; Central Road; Dunton Street; Marshall Street; Rugby Street, & Repton Street.

• To introduce limited waiting bays that will allow vehicles to wait for up to 1 hour with a ‘no return’ period of 1 hour to operate between 9.00am & 6.00pm Monday to Saturday & which will be/revert to unrestricted at all other times including Sundays on parts of: Balfour Street; Bassett; Bonchurch Street; Central Road; Dunton Street, & Marshall Street.

• To introduce limited waiting bays that will allow vehicles to wait for up to 5 minutes with a ‘no return’ period of 15 minutes to operate between 8.00am & 5.00pm Monday to Friday on parts of Balfour Street. These bays will revert to zone ‘M’ residents’ permit holders overnight & at weekends.

• To provide Shared Use Parking Places for Residents permit holders operating all hours on all days, and Pay & display/pay by phone parking chargeable by the hour (£0.50 per hour) operating on all days from 8am to 11pm on parts the following road(s): Repton St & Bonchurch St.

• To reduce the lengths of junction protection (double yellow lines) which prohibit vehicles from waiting at all times on the following junctions: - Rugby Street with Dunton Street, Rugby St with Repton St & Central Road with Repton Street.

• To revoke certain existing Prohibitions, Restrictions and Provisions.

Schedule 2
The reason for these changes is to update the part numbers listed within the Articles for this Order and the 2006 Consolidation Order. This will conform to legislation and traffic trends.

No person shall cause or permit a vehicle to wait for more than 1 hour or to return to the same length
of limited waiting restriction within the next consecutive period of 1 hour between 9.00am and 6.00pm
Monday to Saturday on any of the roads or lengths of road specified to which this restriction is applied. At
all other times & including Sundays this shall be a general parking place where vehicles can park without
time limit or payment

Section 5
Designated Parking Place or Parking Area Restrictions

Part 434 Shared Use Designated Pay & Display/Pay by Phone and Residents Parking Place.
No person shall cause or permit a vehicle to wait at any time on any length of road specified to which this
restriction is applied except a vehicle displaying a residents parking permit or a visitors permit valid for that
parking place, the permits shall have an identifying letter that is also being indicated on the traffic sign for
that restriction applicable to that parking place. Between the hours of 8am and 11pm on all days (including
Bank holidays) this length of road may also be used as a designated parking place (pay & display). Where a
ticket machine is provided to support the parking place(s), before leaving a vehicle on any road or length of
road to which this restriction applies, the driver shall pay the parking charge as set out for Tariff Zone 11 by
purchasing a ticket from a ticket machine and display in accordance with the conditions set out in Section 9
of this Order by displaying the ticket in the relevant position. Or as an alternative method of payment using
an electronic device for the Pay by Phone option to record a virtual ticket on the council’s or its agent’s data
base. Where no ticket machine is provided, the parking place(s) will be Pay by Phone only. All vehicles must be
parked wholly within the parking bay marked on the carriageway. Whilst parked in the parking bay no person
shall carry out any work relating to the construction or repair of the vehicle other than may be necessary to
enable the vehicle to be moved from the bay. No person shall allow a vehicle waiting in a parking bay to be
used for or in connection with the sale of any vehicle or any other article or for the offer of any service for
reward. Provided that this restriction shall not apply to permit holders or a vehicle displaying a valid disabled
person’s badge issued and displayed in accordance with the Regulations and includes similar badges issued
by other European Member States

Designated Residents Parking Place.

No person shall cause or permit a vehicle to wait between midnight - 8am and 5pm-midnight Monday to
Friday & all day on Saturday & Sunday on any length of road specified to which this restriction is applied
except a vehicle displaying a residents parking permit or a visitors permit valid for that parking place, the
permits shall have an identifying letter that is also being indicated on the traffic sign for that restriction
applicable to that parking place. No person shall allow a vehicle waiting in a parking bay to be used for
or in connection with the sale of any vehicle or any other article or for the offer of any service for reward.
Provided that this restriction shall not apply to permit holders or a vehicle displaying a valid disabled person’s
badge issued and displayed in accordance with the Regulations and includes similar badges issued by other
European Member States.

All existing waiting and manoeuvre traffic restrictions on the roads listed in Schedule 1 & that are currently in operation under the Leicester (Consolidation) Traffic Regulation Order 2006 (as amended) & which are not subject to the changes described, will be re-created as part of this Order.

There will be exemptions provided, for example: Emergency Services, for vehicles stopping to avoid an accident, taxi or picking up and drop off passengers. A COPY of the Order, the relevant plan, the Council’s statement of reasons for making the Order and extract copies of the Order being amended may be seen during normal opening hours at Leicester City Council, Customer Service Centre, 91 Granby Street, Leicester, LE1 6FB. OBJECTIONS to the proposed Order should be made in writing by post to Leicester City Council, City Hall, 115, Charles Street, Leicester, LE1 1FZ or by e-mail to troyorkhouse@leicester.gov.uk. Any objections should state the grounds on which they are made and must be received by 21st day of October 2024. The formal reason for these proposals is for preserving or improving the amenities of the area through which the roads run.

The Order is to introduce a Residents permit parking only past this point (except in signed bays) Residents’ permit zone (‘M’) on: Bassett Street, Balfour Street, Bonchurch Street, Central Road, Dunton Street, Marshall Street, Rugby Street, Repton Street. Only permit holders can park on these streets. To support local business & amenities there will be limited waiting bays that will allow visitors to park for up to 1 hour during the daytime. These bays will be unrestricted overnight. Shared use bays will be provided on Bonchurch Street & Repton Street that will allow zone ‘M’ permit holder parking at all times & allow shoppers to pay by machine or by phone between 8am & 11pm. Limited waiting bays will be provided on Balfour St that will allow waiting for 5 minutes between 8am & 5pm Monday to Saturday & which will revert to permit zone ‘M’ permit holder parking overnight & at weekends.
