Amendments to Waiting and Parking Restrictions In the Borough of Elmbridge
On 10 September 2024 Surrey County Council (“the Council”) made the following order, with modifications, under Sections 1, 2, 4, 32, 35, 36, 45, 46, 49, 51, and 53 of and Part IV of Schedule 9 the Road Traffic and Regulation Act 1984 (“the Act”), which will come into force on 16 September 2024: -
1. The Surrey County Council (Various Roads in Elmbridge) (Waiting Loading and Unloading Restriction and On-Street Parking Places Orders) (amendment No. 3) Order 2024, which will amend the following Orders: - (1) The Surrey County Council Various Roads in the Borough of Elmbridge (Consolidation and Revocation of Controlled Parking Zones) Order 2021; (2) The Surrey County Council Various Roads in the Borough of Elmbridge (Consolidation and Revocation of Residents’ On-Street Parking Places) Order 2021; (3) The Surrey County Council (Various Roads in Elmbridge) (Revocation and Consolidation of Waiting, Loading and Unloading Prohibition and Restriction) Order 2021; (4) The Surrey County Council (Various Roads in Elmbridge) (Consolidation and Revocation of Free Street Parking Places and Loading Bays) Order 2021; (5) The Surrey County Council (Various Roads in Elmbridge) (Consolidation and Revocation of Free Street Parking Places) (Disabled Persons) Order 2021; (6) The Surrey County Council (Various Roads in the Borough of Elmbridge) (Consolidation and Revocation of Prohibition of Stopping Outside Schools) Order 2021; (7) The Surrey County Council Various Roads in Elmbridge) (Consolidation and Revocation of Prohibition of Waiting of Heavy Commercial Vehicles) Order 2021; (8) The Surrey County Council (Borough of Elmbridge) (Consolidation and Revocation of Solo Motor Cycle Parking Places) Order 2021; and (9) The Surrey County Council Various Roads in the Borough of Elmbridge (Consolidation and Revocation of On-Street Car Club Parking Places) Order 2021; so as to make the following provisions: -
(a) Prohibit the waiting by vehicles in certain lengths of the roads specified in the First Schedule to this Notice, during the times and on the days specified in the said Schedule;
(b) Provide that the usual exemptions, for loading on and unloading from vehicles, boarding and alighting from vehicles, for works on or adjoining the said lengths of roads, the maintenance of those roads and the services in them and for disabled persons vehicles in accordance with the Blue Badge Scheme, would apply;
(c) Revoke such waiting restrictions in certain lengths of the roads specified in the Second Schedule to this Notice, without replacement;
(d) Prohibit the waiting by heavy commercial vehicles (over 5 tonnes) in Faulkner’s Road, Hersham, subject to certain exemptions such as for loading and unloading, emergency service vehicles etc.
(e) Provide such free on-street parking places in certain lengths of the roads in the Third Schedule to this Notice, to operate on the days and at the times specified therein;
(f) Specify that the vehicles which may be left the free on-street parking places shall be passenger vehicles (8 seats or less), motor cycles, invalid carriages and goods vehicles under 5 tonnes;
(g) Provide a residents’ only parking place, Monday-Saturday 9am7pm, in Park Road, Esher, for use by Esher Green Controlled Parking Zone (CPZ) permit holders;
(h) Provide residents’ only parking places, Monday-Saturday 9am6pm, in Springfield Meadows, Weybridge, for use by Weybridge CPZ permit holders;
(i) Provide shared use parking places Monday-Saturday 8am-6pm permit holders (Cobham CPZ) or free parking limited to 2 hours no return 2 hours in Cedar Road, Cobham, and include the property known as “Limes” in the list of those eligible for a resident’s permit in the said CPZ;
(j) Include Park Square in the list of roads eligible for permits for the Esher Green CPZ; and add Oakdene Court in the list of roads eligible for permits in the Walton CPZ;
(k) Vehicles left by specified disabled persons may wait in the onstreet parking places specified above, without time limit at any time and certain other vehicles may wait in such parking places in certain circumstances, e.g., to allow persons to load or unload (maximum 20 minutes), emergency vehicles, etc. and outside of the hours of operation indicated any vehicle may be left for any period without time limit;
(l) Provide disabled persons’ free on-street parking places operational at any time without time limit in Canada Road, Cobham and Thames Street, Walton-On-Thames: certain other vehicles may wait in the disabled persons’ free on-street parking places in certain circumstances e. g. to allow persons to board or alight (maximum 2 minutes) to load or unload (maximum 20 minutes), etc.;
(m) Revoke a disabled persons’ parking place (without limit) in Bennett Close, Cobham;
(n) Introduce a car club parking place operating at any time for holders of a car club permit in Thamesmead (CC-304), subject to certain exemptions such as emergency service vehicles, but no exemption shall apply to blue badge holders;
(o) Extend the existing prohibition of stopping by vehicles, in Portmore Way, Weybridge as indicated by zig-zag markings on site. Exemptions shall apply for any person causing a vehicle to stop in order to avoid an accident, or if required to do so by law, anything done with the permission of a police constable in uniform or in accordance with any sign placed by Surrey Police, or for any vehicle displaying a valid waiver certificate issued by the Council;
(p) Revoke the school keep clear restrictions (Monday-Friday 8.15am-9.15am and 2.30pm-4pm) in Beauchamp Road, West Molesey, to be replaced by a Zebra Crossing and associated keep clear markings.
2. The East Molesey Controlled Parking Zone will be revoked. This will change the signing of the restrictions on the ground. The only changes to the waiting restrictions therein will be; (1) “no waiting” at any time restrictions will be introduced, in parts of Creek Road, at the accesses to Nos. 3, 25, Creek Cottages and the rear access to 2-6 Bridge Road; Bridge Road, outside the Prince of Wales pub and Ellu Amour Boutique; (2) a free parking place Monday-Sunday 8am-6pm, limited to 30 mins no return within 2 hours in Bridge Road outside Nos. 25/27 will be provided. Exemptions will be as for similar restrictions indicated above.
3. Drafting amendments will be made to the Orders specified herein to allow to remove references to the Borough Council relating to the operation of parking enforcement.
4. The Council also make The Surrey County Council (Various Roads in Elmbridge) Electric Vehicle Parking Places Order 2024, under Sections 32, 35 and 36 of the Act, which will also come into force on 16 September 2024, and which will introduce such electric vehicle on-street parking places in certain lengths of Ashley Park Avenue, Walton-On-Thames, operational Monday-Sunday 8am-6pm limited to 2 hours, for use by by electric vehicles or hybrid vehicles for the purpose of charging the said vehicle by use of the electric charging post installed in respect of that parking place; Certain other vehicles may wait in such parking places in certain circumstances e.g. to allow persons to board or alight (maximum 2 minutes) to load or unload (maximum 20 minutes), etc. but no exemption shall apply to blue badge holders.
Where a new restriction is imposed in this Notice, any existing restriction on the same length of road will be revoked.
A copy of the Orders, together with plans showing the lengths of roads to which the Orders relate and a Statement of the Council’s reasons for making the Orders may be inspected at (a) Surrey Highways, Hazel House, Merrow Lane, Guildford, Surrey, GU4 7BQ (by appointment) (b) Elmbridge Borough Council, Civic Centre, High Street, Esher, KT10 9SD, (by appointment), (c) Walton Library, 54 The Heart (off Hepworth Way), Walton on Thames, Surrey KT12 1GH, (d) Hersham Library, Molesey Road, Hersham, Surrey KT12 4RF (e) Weybridge Library, Church Street, Weybridge, Surrey KT13 8DE, (f) Molesey Library, The Forum, Walton Road, West Molesey, Surrey KT8 2HZ, (g) Cobham Library, The Cedar Centre, Cedar Road, Cobham, Surrey KT11 2AE, and (h) Dittons Library, Mercer Close, Thames Ditton, Surrey, KT7 0BS, during normal opening hours, until six weeks from the date of the making of the Orders. The said plans and Statement of Reasons may also be viewed on our website, at www. surreycc.gov.uk/elmbridgeparking. If you wish to question the validity of any of these Orders or any provision contained in them, on the grounds that it is not within the powers conferred by the Act, or on grounds that any requirement of the act, or any instrument made under it, has not been complied with, in relation to the Order, you may, within six weeks from the date of the making of the Orders, apply to the High Court for this purpose.
Any reference to a road in this Notice is a reference to part of the road only.
