What is happening?

WARRINGTON BOROUGH COUNCIL

Road Traffic Regulation Act 1984 Fairways, Beechways & Pineways, Appleton (Prohibition of Driving, Clearway & Footway Closure) Temporary Order 2024

Notice is hereby given that the Council made an Order under Section 14 of the Road Traffic Regulation Act 1984. The effect of which is to introduce a prohibition of driving, clearway & footway closure as follows: Fairways from its jct. with Beechways for 50m; Beechways from a point 25m north of its jct. with Fairways to 25m south of its jct. with Pineways; Pineways from its jct. with Beechways for 50m. The Order will be effective from 2nd September 2024 for 8 weeks, between 8:30am & 5:30pm, as & when signed on site. Access will be under the control of the relevant Contractor for the duration of the works. The alternative routes will be: Fairways via London Rd, Dudlow Green Rd, Beechways & vice versa; Pineways via Dudlow Green Rd, Beechways & vice versa. The restrictions are required for footway maintenance/improvements. Ref: 10604468

The Borough of Warrington (St. Philip Westbrook C of E Primary School) (Traffic Management Scheme) Order 2024

Notice is hereby given that the Council made an Order under Sections 1, 2, 3 & 4 of the Road Traffic Regulation Act 1984 & of all other enabling powers on 28th August 2024. The effect of the Order is to introduce a Prohibition of Motor Vehicles on Monday to Friday between 8:30am to 8:55am & 2:55pm to 3:30pm (term time only) on the roads specified in the Schedule to this Notice, Pedal Cycles & Invalid Carriages will be permitted. The Order will be effective from 4th September 2024.

Schedule - Prohibition of Motor Vehicles, Monday to Friday between 8:30am to 8:55am & 2:55pm to 3:30pm (Term Time Only) Westbrook Centre (East-West Section) - From its jct. with Westbrook Cres for approx. 120m in an easterly direction, for vehicles travelling in only an easterly direction; Westbrook Centre (East-West Section) - From a point approx. 120m north east of its jct. with Westbrook Cres to its jct. with Westbrook Centre (North/South Section). The Borough of Warrington (Various Roads) (20 MPH Speed Limits) Consolidation (Amendment No. 3) Order 2024

Notice is hereby given that the Council made an Order under Sections 1, 2, 4, 84 & Part IV of Schedule 9 to the Road Traffic Regulation Act 1984 & of all other enabling powers on 28th August 2024. The effect of the Order is as follows:-

1) The Borough of Warrington (Various Roads) (20 MPH Speed Limits) Consolidation Order 2024, is hereby further varied or amended in so far as it relates to Schedule 2 - 20 MPH Speed Limits by the addition of the following: Westbrook Centre (East-West Section) from its jct. with Westbrook Cres to its jct. with Westbrook Centre (North-South Section); Westbrook Centre (North-South Section) from its jct. with Westbrook Cres for its entire length. The Order will be effective from 4th September 2024. Ref: 10001513

Any person who wishes to question the validity of the Permanent Orders or of any provision contained in them on the grounds that they are not within the powers conferred by the Road Traffic Regulation Act 1984 or on the grounds that any requirement of that Act or any instrument made under it has not been complied with in relation to the Orders may, within six weeks from 28th August 2024, apply to the High Court for this purpose.

The Borough of Warrington (Traffic Management) (Civil Enforcement) (Amendment No. 68) Experimental Order 2024

Notice is hereby given that on 28th August 2024 the Council made the abovementioned Order under Sections 1, 4, 9 & 10 of the Road Traffic Regulation Act 1984 & of all other enabling Powers. The effect of the Order is as follows:-

1. The Borough of Warrington (Old Cherry Lane, Lymm) (Prohibition of driving - Except for access) Order 2013, is hereby suspended in its entirety.

2. The Borough of Warrington (Traffic Management) (Civil Enforcement) Consolidation Order 2018, is hereby further varied or amended as follows: -

(a) In the 3rd Schedule by the suspension of: No waiting at any time: Cherry Corner (South East Side) - From its jct. with Cherry Ln, following the kerb line to its south easterly most point, in a southerly direction.

(b) By the addition of a new section under Part 5 - Permit Holders Parking Only Past This Point & the following entry thereunder: -

Permit Holders Parking Only Past This Point

24(d).The lengths of road and sides of roads specified in Schedule 98 to this Order are designated as Permit Holders Parking Only Past This Point, where save as provided in Article 35c to this Order, no person, except with the direction or with the permission of a person authorised by the Council, Police Constable in uniform or Police Community Support Officer in uniform shall cause or permit any Motor Vehicle to enter at any time into the lengths of road specified in the said Schedule unless a valid Permit is displayed in the Relevant Position.

(c) By the addition of a new Article 35c & the following entry thereunder: -

35c. Nothing in Article 24(d) to this Order shall render it unlawful to cause or permit any Motor Vehicle to enter the roads or sides of roads referred to therein if it is necessary for the following purposes:-

(a) the Motor Vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in conjunction with any of the following operations:

(i) building, industrial or demolition operation;

(ii) the removal of any obstruction to traffic;

(iii) the laying, erection, alteration or repair in, or on land adjacent to the said roads, or sides of roads of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity, or of any telecommunication apparatus as defined in Paragraph 1(1) of the Telecommunications Act 1984;

(b) the Motor Vehicle if it cannot conveniently be used for such purpose in any other road, to be used in the service of a local authority or of a water authority in pursuance of statutory powers or duties;

(c) the Motor Vehicle to be used for the purpose of Delivering or Collecting postal packets as defined in Section 87 of the Post Office Act 1953;

(d) the Motor Vehicle to be used for Fire Brigade, Ambulance or Police purposes.

(d) By the addition of a new Schedule & the following entry thereunder: -

Areas of Highway designated as Permit Holders Parking Only Past This Point, each area described below in this column being an area forming part of the carriageway of a specified highway, is reserved for Permit Holders Only

Permitted Hours of Operation

Cherry Corner for its entire length.

At all times

All that part of Old Cherry Ln from its jct. with Cherry Corner in a south westerly direction to & including its cul de sac end.

At all times

(e) By the amendment of Article 53(a) being the addition of Schedule 98 to the said Article. The Order will be effective from 5th September 2024 & will remain in force for a period not exceeding 18 months. The Council will be considering in due course, within the Experimental Order period, whether the provisions of the Experimental Order should continue in force indefinitely. All representations both in support or objecting to the proposals must be in writing either by post or delivered by hand to Legal Services, East Annexe, Town Hall, Sankey St, Warrington, WA1 1UH or emailed to TROrepresentations@warrington.gov.uk & be received within 6 months of the Experimental Order coming into force. All objections must specify the grounds on which they are made. Please note that all representations received may be considered in public by the Council & that the substance of any representation together with the name & address of the person making it could become available for public inspection.
