The Borough Of Oldham Definitive Map And Statement (Footpath 294 Saddleworth) Modification Order 2023
The above Order made on 12th April 2023, was confirmed by the Council without modification on 4th July 2024. The confirmed Order modifies the definitive map and statement for the area by adding to them the footpath from point A on Dobcross New Road, Dobcross (GR SD98996 06377) opposite the former Woolpack Inn proceeding south east for a distance of approximately 57 metres to point C (GR SD99045 06352).
Then proceeding directly east following the northern boundary of the Woolpack playing fields for a distance of approximately 169 metres to point D (GR SD99213 06367) where there is a branch heading north west for a distance of approximately 61 metres back onto Dobcross New Road at point B (GR SD99159 06391) via steps (9 risers varying depth).
Continuing from point D for a distance of approximately 19 metres east across a footbridge spanning the River Tame at point E (GR SD99230 06367) and heading in a general south easterly direction for a distance of approximately 277 metres across the Newbank Garden Centre access road and car park to the chicane located at the eastern end of the car park at point F (GR SD99463 06261).
Then heading north east then south east in a semi-circular route with the River Tame to the left for a distance of approximately 84 metres to Mow Halls Lane at point G (GR SD99535 06264) at the junction of Footpath 103 Saddleworth. The Order took effect on 4th July 2024.
A copy of the Order and the Order map as confirmed may be seen free of charge at the Civic Entrance Reception, Civic Centre, West Street, Oldham, between the hours of 8.40am to 5.00pm (Ref: AE/FD1/23). Copies of the order and map may be bought there at the price of £1.
If any person is aggrieved by the Order and desires to question its validity on the ground that it is not within the powers of section 53 of the Wildlife and Countryside Act 1981 (“the Act”) or that the requirements of Schedule 15 of the Act have not been complied with in relation to it, he may within 42 days from the date of publication of this notice make an application to the High Court under paragraph 11 of Schedule 15.
On any such application the High Court may, if satisfied that the Order is not within those powers or that the interests of the applicant have been substantially prejudiced by a failure to comply with those requirements, quash the Order or any provision of the Order, either generally or in so far as it affects the interests of the applicant.
