ON AND OFF-STREET PARKING CHARGE REVISIONS THE LONDON BOROUGH OF BARKING AND DAGENHAM (OFF STREET PARKING PLACES) AMENDMENT NO. 38 ORDER 2024

THE LONDON BOROUGH OF BARKING AND DAGENHAM (CHARGED-FOR PARKING PLACES) AMENDMENT NO. 130 ORDER 2024

NOTICE IS HEREBY GIVEN that the Council of the London Borough of Barking and Dagenham in exercise of its powers under Sections 6, 32, 33, 35, 45, 46, 49 and 124 and Parts I to IV of Schedule 9 of the Road Traffic Regulation Act 1984 as amended (hereafter called "the Act'') and of all other enabling legislation and powers and after consultation with the Commissioner of Police of the Metropolis in accordance with Part IV of Schedule 9 of the Act made the above Orders, the effect of which will be to introduce changes to the London Borough of Barking and Dagenham (Off-Street Parking Places) Order 2017, "the Off-Street Order" and the London Borough of Barking and Dagenham (Charged-For Parking Places) Consolidation Order 2016, "the Charged-For Order and the London Borough of Barking and Dagenham (Free Parking Places, Loading Places and Waiting, Loading and Stopping Restrictions) Consolidation Order 2016, "the Free Order as follows:

1. To substitute Schedule 2 to the Off-Street Order with Schedule 1 to this Notice;

2. To substitute Schedule 4 to the Off-Street Order with Schedule 2 to this Notice;

3. The Items and Notes shown in Schedule 3 to this Notice shall replace those Items and Notes in Schedule 1 to the Off-Street Order;

4. A charge will be issued to release vehicles from locked car park locations as shown in the Notes in Schedule 3 to this Notice.

5. To substitute Schedule 4 to the Charged-For Order with Schedule 4 to this Notice;

6. On-Street Motorcycle Permits will now also be issued for Daily periods.

7. 3 month and 6 month season tickets will now be issued for Wantz Road Car Park, Dagenham as shown in Schedule 3 to this Notice.

8. To introduce an annual dropped kerb waiver. An administration charge for processing of an annual dropped kerb waiver shall be issued and appended to Schedule 3 of the Free Order as shown in Schedule 6 to this Notice, to exempt vehicles from waiting on a restricted street for waiting during prescribed hours within a controlled parking zone if that vehicle is waiting on a dropped kerb owned by the owner of the vehicle and resides at that property (and the dropped kerb is not shared with any other properties).

9. Riverside Area 3, 6 and 12 month permits will no longer be issued and will be replaced with Riverside Area (GCSP) Staff Permits which will be issued to staff at George Carey School only.

10. To substitute Schedule 7 to the Charged-For Order with Schedule 5 to this Notice

11. Note that Notes (6) of Schedule 5 to this Notice will increase to £1.10 as stated in the Notice of Variation in Article

12 and will become effective on Thursday 1 August 2024;

Any proposed Orders that the Council has already published a Notice of their intention to make new charged for parking, which then comes into effect after the making of these Orders will be subject to the parking charges as set out in these Orders and not the charges as included in any original Notice of Intention previously published.

A copy of the Orders, which will come into force on Monday 15 July 2024 and the Council's Statement of Reasons for making the Orders are available to view for a period of 6 weeks from the date on which this notice is published on the Councils website by visiting the following webpage https://www.lbbd.gov.uk/parking/parking-area and selecting 'New and proposed traffic and parking schemes' or available for inspection at the Adult Library, First Floor, Barking Learning Centre, Barking between the hours of 9.00am and 4.00pm Monday to Friday.

Any person wishing to question the validity of the Order or of any of its provisions on the grounds that they are not within the powers of the Act, or that any requirement of the Act or any Regulations under it have not been complied with may do so within six weeks of the made date of the Order by applying to the High Court.

The Council of the London Borough of Barking and Dagenham ALSO GIVES NOTICE under section 46A of the Road Traffic Regulation Act 1984 of a variation to the charges for Payment Parking Places as stated in Schedule 7 of the Charged-For Order. The new variation of charges as indicated in Article 12 will take effect on Thursday 1 August 2024

12. The effect of the variation is to increase the charges for TC2 up to 4 hours parking payments for diesel vehicles that do not meet Euro 6 emission standards.

a. The current charge is:

i. An additional charge of £1.00 will be applied to all TC2 Up to 4 hours parking payments for diesel vehicles that do not meet Euro 6 emission standards.

b. The charge applicable after the effective date of the variation is:

ii. An additional charge of £1.10 will be applied to all TC2 Up to 4 hours parking payments for diesel vehicles that do not meet Euro 6 emission standards.

(3) An additional charge of £100 will be applied to all Staff Permits - Standard (Annual) parking permits for diesel vehicles that do not meet Euro 6 emission standards.

(4) An additional charge of £100 will be applied to all Staff Permits - Red (Annual) and parking permits for diesel vehicles that do not meet Euro 6 emission standards.

(5) Tariff Band 1 refers to Emissions (C02) g/km 0-50, Band 2 refers to Emissions (C02) g/km 51-100, Band 3 refers to Emissions (C02) g/km 101-140, Band 4 refers to Emissions (C02) g/km 141-160, Band 5 refers to Emissions (C02) g/km 161-180, Band 6 refers to Emissions (C02) g/ km 181-255, Band 7 refers to Emissions (C02) g/km Over 256.

(6) An additional charge of £1.00 will be applied to all Staff Permits - Standard (4 Hours), Staff Permits - Standard (Daily) parking permits for diesel vehicles that do not meet Euro 6 emission standards.

(7) When commencing the start of the parking period (including a free parking period) the vehicle must be registered on the telephone payment parking system, app or at a pay point location. For any period of parking in excess of a free parking period a charge applies as stated in the table above

(2) Only applicable in Off-Street Car Parks where use of Residents' Permits is permitted.

(3) An additional charge of £100 will be applied to all resident, Business / Trade (Annual), Operational Permit-Annual and Healthcare Permit-Annual parking permits for diesel vehicles that do not meet Euro 6 emission standards.

(4) Any additional vehicle resident permits in excess of 2 vehicles are subject to a minimum charge of £45.

(5) An additional charge of £1 will be applied to all Operational Permit - Daily, Operational Permit - 4 Hour, Healthcare Permit-Daily, Healthcare Permit-4 Hour, Business/Trade (Daily) and Business / Trade (4 Hour) parking permits for diesel vehicles that do not meet Euro 6 emission standards.

(6) An additional charge of £2.10 will be applied to all Parking Waiver-Weekly parking permits for diesel vehicles that do not meet Euro 6 emission standards.

(7) An additional charge of £10 will be applied to all Temporary parking permits for diesel vehicles that do not meet Euro 6 emission standards.

(8) An additional charge of £1.10 will be applied to all Parking Waiver - Daily parking permits for diesel vehicles that do not meet Euro 6 emission standards.
