NOTICE OF CONFIRMATION OF PUBLIC PATH ORDER HIGHWAYS ACT 1980 SECTION 119

THE DERBYSHIRE COUNTY COUNCIL

(PUBLIC FOOTPATH NO. 35 (PART) - PARISH OF HARTSHORNE)

PUBLIC PATH DIVERSION ORDER 2023

On 28 March 2024, Derbyshire County Council confirmed the above order. The effect of the order as confirmed is to divert the whole width of that part of Hartshorne Public Footpath No. 35 commencing from Point A (GR SK 3280 2174) at its junction with Hartshorne Footpath No 36 proceeding in a generally north easterly then east north easterly direction to Point B (GR SK 3293 2181), then in a generally north easterly direction to its junction with Hartshorne Footpath No 31 at Point C, a total distance of 395 metres or thereabouts to a 2 metre wide grass surfaced footpath at Rowan Woods and land lying to the west of Ticknall Road in Hartshorne, commencing from the aforementioned Point A (GR SK 3280 2174) and proceeding in a generally east, north easterly direction to Point D (GR SK 3292 2179), continuing in a generally east north easterly direction, turning in a generally east south easterly direction to Point E (GR SK 3305 2178) finally turning in a generally north easterly direction to Point C (GR SK 3312 2196), a total distance of 466 metres or thereabouts, as shown on the order map.

Documents can also be seen free of charge at County Hall, Matlock during normal office hours where copies may be bought at the price of £1.00 or at Woodville Library, 1 Hartshorne Road, Woodville, Swadlincote, DE11 7JB during normal opening hours.

The order came into force on 28 March 2024 but if any person aggrieved by the order desires to question its validity or that of any provision contained in it on the ground that it is not within the powers of the above Act, or on the ground that any requirement of that Act or any regulation made under it has not been complied with in relation to the confirmation of the order, he or she may apply to the High Court for any of those purposes under Section 119 of Highways Act 1980 within 6 weeks from the date on which notice is first published.
