NOTICE OF MAKING

(OFF-STREET PARKING PLACES) (CONSOLIDATED) ORDER 2015 (VARIATION NO. 10) ORDER 2024

Notice is hereby given that Cheshire East Borough Council have made an Order on 12th June 2024 in exercise of its powers under Sections 32, 35, 35C and Part IV of Schedule 9 of the Road Traffic Regulation Act 1984, as amended, ("the 1984 Act") and all other enabling powers and in accordance with its duty under Section 122 of the 1984 Act.

The effect of the Order, which will come into operation on 8th July 2024, will be to vary the Cheshire East Borough Council (Off-Street Parking Places) (Consolidated) Order 2015 (as amended) as follows:

1. Insert a new definition in the Consolidation Order after "Relevant Position" as follows:

"Tariff Band" means a Parking Permit tariff band which is Low, Medium, High or Railway as displayed on the Parking Permit.

2. Insert a new definition in the Consolidation Order after "High" as follows:

"Low" means a Tariff Band with a quarterly rate of £163.00 and a yearly rate of £490.00. A Low Tariff Band Parking Permit may only be used in Low Tariff Band Parking Place.

3. Insert a new definition in the Consolidation Order after "Low" as follows:

"Medium" means a Tariff Band with a quarterly rate of £195.00 and a yearly rate of £620.00. A Medium Tariff Band Parking Permit may be used in a Low or Medium Tariff Band Parking Place.

4. Insert a new definition in the Consolidation Order after "Hackney Carriage Plate" as follows:

"High" means a Tariff Band with a quarterly rate of £228.00 and a yearly rate of £750.00. A High Tariff Band Parking Permit may be used in a Low, Medium or High Tariff Band Parking Place.

5. Insert a new definition in the Consolidation Order after "Penalty Charge Notice" as follows:

"Railway" means a Tariff Band with a quarterly rate of £310.00 and a yearly rate £1,080.00. A Railway Tariff Band Parking Permit may be used in a Low, Medium, High or Railway Tariff Band Parking Place

6. Clause 30 in the Consolidation Order will be deleted in its entirety and replaced with the following:

"30. The Council may make Parking Permits or Virtual Parking Permits available, and these shall be at the appropriate fee (if any), for a Vehicle of a specific class and for a specific Tariff Band subject to any conditions as may be determined by the Council from time to time."

7. Clause 32 in the Consolidation Order will be deleted in its entirety and replaced with the following:

"32. A Parking Permit or Virtual Parking Permit is only valid in a Parking Place where a Tariff Band equal to or lower than the Tariff Band specified within the Parking Permit or Virtual Parking Permit applies and up to the date of expiry shown on the Parking Permit or Virtual Parking Permit."

8. The Tariffs set out in the Schedule to this Order on the following car parks; Fairview Car Park, Alsager (long and short stay), Southway Car Park, Middlewich; Springfields Car Park, Prestbury; Westfields Car Park, Sandbach shall apply from 9am Monday to Friday during school term times and 8am Monday to Friday otherwise.

9. To amend the Tariffs in the Schedule to the Order as follows:

Any person who desires to question the validity of the Order or any of its provisions on the grounds that it is not within the powers conferred by the Act, or any requirement of the Act or an instrument made under the Act has not been complied with, that person may, within 6 weeks from the date on which the Order is made, apply for the purpose to the High Court.
