What is happening?

NOTICE OF CONFIRMATION OF A PUBLIC PATH EXTINGUISHMENT AND
DEFINITIVE MAP AND STATEMENT MODIFICATION ORDER

CHORLEY PUBLIC PATH EXTINGUISHMENT ORDER 2023

On the 25 January 2024, Lancashire County Council confirmed the above Order made under section 118 of the Highways Act 1980.

The effect of the Order, as confirmed is to extinguish the footpath running from a point on the southern edge of the footway of Haydock Drive to the west of Duxbury Manor Way and on the northern boundary of 1D Duxbury Manor Way at SD 5888 1588, running south east for 10 metres to SD 5889 1587 at the eastern boundary of the garden of 1D Duxbury Manor Way where it meets the western edge of the footway, as shown on the Order Map.

A copy of the Order as confirmed, and the Order Map have been placed and may be seen free of charge at my offices from 9am to 5pm on weekdays. Copies of the Order and Map may be bought there at the price of £1.00. Alternatively, digital copies of the Order and Map may be requested by emailing Simon Moore at simon.moore@lancashire.gov.uk

Any person who wishes to claim compensation under Section 28 as applied by Section 121(2) of the 1980 Act for depreciation or damage for disturbance arising as a result of the coming into force of the Order must make a claim in writing addressed to the Director of Law and Governance, Lancashire County Council, PO Box 100, County Hall, Preston, PR1 0LD (REF: LSG4/SM18/888.3642/211-755), and serve it by delivering it at, or sending it by prepaid post to, that address not later than the 11 December 2024. A copy of the section is attached.

The Order comes into force on the 11 June 2024 but if a person aggrieved by the Order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that a requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the Order, he or she may, under Paragraph 2 of Schedule 2 to the Act as applied by Paragraph 5 of Schedule 6 to the Act, within six weeks from the 11 June 2024, make an application to the High Court.
