THE HIGHLAND COUNCIL (U3049 FROM C1171 AT MOYNESS SMITHY TO C1157 AT GOLFORD AULDEARN – BT WORKS) (TEMPORARY CLOSURE) NOTICE 2024

The Highland Council in exercise of the powers conferred on them by Section 14(2) of the Road Traffic Regulation Act 1984, as amended, and of all other powers enabling them on that behalf being satisfied that traffic on the length of road referred to in the Schedule (‘’the Schedule’’) annexed to this Notice should be restricted or prohibited because works are being or are proposed to be executed on or near that length of road hereby make this Notice.

Citation, commencement and cessation
1. This Notice may be cited as ‘The Highland Council (U3049 From C1171 At Moyness Smithy To C1157 At Golford, Auldearn - BT Works) (Temporary Closure) Notice 2024’ and shall be in operation from Monday 20th May 2024 until Friday 7th June 2024.

Interpretation
2. The Interpretation Act 1978 shall apply for the interpretation of this Notice as it applies for the interpretation of an Act of Parliament.

Relationship to existing Orders
3. All provisions contained in any Order Enactment or others in so far as the same repeat or are inconsistent with the provisions of this Notice and the true intent or meaning hereof shall cease to have effect, during the period stated hereto.

Reason
4. The Highland Council’s Roads Authority are satisfied that traffic on the road should be restricted or prohibited because of the likelihood of danger to the public, or of serious damage to the road, which is not attributable to such works that are being or are proposed to be executed on or near the road specified in the Schedule to this Notice.

Alternative routes
5. Consideration has been given to the safety and convenience of alternative routes suitable for the traffic which will be affected by this Notice and shall be signed.

Temporary prohibition on use of a road
6. Save as provided for in Article 7 of this Notice, while this Notice is in force, no person shall drive, or cause or permit any vehicle to be driven on the length of road, or a part or parts of the length of road, specified in the Schedule when a prohibition is identified as applying by means of one or more of the traffic signs of a type generally provided for under Section 64 of the Road Traffic Regulation Act 1984, as amended.

Exemptions
7. Nothing in Article 6 of this Notice applies to:
(a) Vehicles employed to carry out the works in respect of which this Notice is made, including those employed to carry out associated traffic management.
(b) Pedestrians.
(c) Cyclists.
(d) Emergency Services’ vehicles, being used in an emergency for Ambulance, Coastguard, Fire Brigade or Police purposes.
(e) Public Service Vehicles.

Sealed with the Common Seal of the Highland Council and subscribed for them and on their behalf in terms of the Local Government etc (Scotland) Act 1994 by Steven Grant (Inverness/NBS Area Roads Operations Manager and Proper Officer) on 10th May 2024.

SCHEDULE

This is the schedule referred to in the foregoing Notice entitled ‘The Highland Council (U3049 From C1171 At Moyness Smithy To C1157 At Golford, Auldearn - BT Works) (Temporary Closure) Notice 2024’.

Length of Road to be Closed
U3049: Commencing a its junction with the C1171 and extending for a distance of 1290 metres or thereby in a north-easterly direction to its junction with the C1157.
Traffic management with signed diversions will be in place. Local access will be maintained.
