NOTICE OF CONFIRMATION OF AN ORDER

PUBLIC PATH DIVERSION AND DEFINITIVE MAP AND STATEMENT

MODIFICATION ORDER

HIGHWAYS ACT 1980, S.119

FP 5 ECCLESHILL (PART) PUBLIC PATH

DIVERSION ORDER 2024

On 25th April 2024 Blackburn with Darwen Borough Council confirmed the above order made under section 119 of the Highways Act 1980 ("the Act") and section 53(A)(2) of the Wildlife and Countryside Act 1981. The effect of the order as confirmed is to divert the public footpath as described in Schedule 1 to this Notice onto the route described in Schedule 2 and as shown on the Order Map.

A copy of the Order and Map may be examined at the Public Notice Boards outside Blackburn Town Hall and Darwen Town Hall free of charge. Copies of the Order may be purchased at the price of 50p, please make a request to Public.RightofWay@blackburn.gov.uk

The order comes into force following 28 days from the date of this notice (not including Public Bank Holidays) but if a person aggrieved by the order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within 6 weeks from the date of this notice, make an application to the High Court.

SCHEDULE 1 - LINE OF EXISTING ROUTE

Footpath 5 Eccleshill

From Roman Road at Pottery Farm, Point A (SD 70030 23623), heading in a generally south-easterly direction via Point B (SD 70128 23548) to join Footpath 8 Eccleshill at Point C (SD 70276 23513) a length of approximately 288 metres.

SCHEDULE 2 - LINE OF DIVERSIONARY ROUTE

Footpath 5 Eccleshill

A path 1.8m wide from Roman Road at Point D (SD 70014 23590) in a southerly direction for approximately 38 metres to Point E (SD 70017 23555) then heading in a generally easterly direction for approximately 270 metres via Point B (SD 70128 23548) to join Footpath 8 Eccleshill at Point C (SD 70276 23513) a length of approximately 308 metres.
