Amendments to Waiting and Parking Restrictions in the District of Tandridge
On 23 January 2024 Surrey County Council made, with modifications, the following orders under Sections 1(1), 2 (1) to (3), 4(2), 32, 35, 36, 45, 46, 47, 48, 49, 51, 52 and 53 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984 (“the Act”): -
1. “The Surrey County Council (Various Roads in Tandridge) (Revocation and Consolidation of Waiting Loading and Unloading Prohibitions and Restrictions) Order 2006 (Amendment No. 14) Order 2024” which will amend “The Surrey County Council (Various Roads in Tandridge) (Revocation and Consolidation of Waiting Loading and Unloading Prohibitions and Restrictions) Order 2006”, so as to prohibit the waiting by vehicles in certain lengths of the roads specified in the First Schedule to this Notice on the days and during the times specified in the said Schedule; Exemptions for loading on and unloading from vehicles, boarding and alighting from vehicles, using vehicles for works on or adjoining the lengths of roads referred to in the First Schedule, the maintenance of those roads and the services in them and for disabled persons’ vehicles in accordance with the Blue Badge Scheme, will apply to the afore-mentioned restrictions;
2. “The Surrey County Council (Various Roads in Tandridge) (Consolidation of Free Street Parking Places) Order 2006 (Amendment No.14) Order 2024” which will amend “The Surrey County Council (Various Roads in Tandridge) (Consolidation of Free Street Parking Places) Order 2006”, so as to (a) revoke the current restriction of Monday to Saturday 8.30am-6pm (no return within 1 hour) from the time limited free on-street parking places outside No.85 Croydon Road, also presently known as “Orbital House” to be replaced with the restriction of Monday to Saturday 8.30am - 6pm 1 hour only (no return within 3 hours); and (b) revoke a 22.2 metre section of the parking bays on the western side of Redehall Road in order to accommodate the new proposed Zebra Crossing.
3. “The Surrey County Council (Various Roads in Tandridge) (Consolidation of Free Street Parking Places) (Disabled Persons) (No.1) Order 2006 (Amendment No.14) Order 2024” which will amend “The Surrey County Council (Various Roads in Tandridge) (Consolidation of Free Street Parking Places) (Disabled Persons) (No.1) Order 2006” so as to (a) provide such free disabled persons on-street parking places in the lengths of roads specified in the Second Schedule to this Notice, providing that certain other vehicles may wait in certain circumstances e.g to allow persons to board or alight (maximum 2 minutes) to load or unload (maximum 20 minutes) etc; and (b) revoke the existing disabled persons’ parking place in Wheelers Lane to be replaced with a No Waiting at any time restriction.
4. “The Surrey County Council (Various Roads in Tandridge) (Prohibition of Stopping Outside Schools) (No.1) Order 2008 (Amendment No.13) Order 2024” which will amend “The Surrey County Council (Various Roads in Tandridge) (Prohibition of Stopping Outside Schools) (No.1) Order 2008” so as to amend the order to match the restrictions already on the ground.
5. “The Surrey County Council (Various Roads in Tandridge) (Free On-Street Loading Bays) Order 2024” which will be to:
(a) To provide a free on-street loading bay in Wheelers Lane, Smallfield, for the purpose of collecting or delivering goods by motor vehicles, from any premises adjacent to or in the vicinity of the loading bay, to be operational at all times and limited to 30 minutes with no return within 3 hours;
(b) Provide that certain other vehicles may wait in the free on-street loading bay referred to above in certain circumstances, e.g.to allow persons to board or alight (maximum 2 minutes), etc.
6. Where a new restriction is proposed in this Notice, any existing restriction on the same length of road shall be revoked.
7. The following Orders are also proposed, the effect of which will be to make legal drafting amendments to the specified Orders which will not affect the operation of the prohibition and restrictions on the ground:-
(a) “The Surrey County Council Various Roads in the District of Tandridge (Residents’ On-Street Parking Place) Order 2019 (Amendment No.4) Order 2024” which will amend “The Surrey County Council Various Roads in the District of Tandridge (Residents’ On-Street Parking Place) Order 2019”;
(b) “Surrey County Council (Various Roads in Tandridge) (Prohibition of Waiting of Heavy Commercial Vehicles) Order 2022 (Amendment No.1) Order 2024” which will amend “Surrey County Council (Various Roads in Tandridge) (Prohibition of Waiting of Heavy Commercial Vehicles) Order 2022”;
(c) “The Surrey County Council (Various Lay-Bys in Tandridge and Westway (D1399) Caterham on the Hill) (Free On-Street Parking Places) Order 2006 (Amendment No.14) Order 2024” which will amend “The Surrey County Council (Various Lay-Bys in Tandridge and Westway (D1399) Caterham on the Hill) (Free On-Street Parking Places) Order 2006”.
A copy of the made Orders, which will come into operation on 01 February 2024, plans showing the lengths of roads to which the Orders relate and a Statement of the Council’s reasons for making the Orders may be inspected, free of charge, at (i) Caterham Hill Library, Westway, Caterham, Surrey, CR3 5TP; (ii) Caterham Valley library, Stafford Road, Caterham, Surrey, CR3 6JG; (iii) Lingfield Library, The Guest House, Vicarage Road, Lingfield, Surrey, RH7 6HA; (iv) Oxted Library, Gresham Road, Oxted, Surrey, RH8 0BQ; (v) Warlingham Library, Shelton Avenue, Warlingham, Surrey, CR6 9NF, during normal opening hours; and (vi) Tandridge District Council, 8 Station Road East, Oxted, Surrey, RH8 0BT, during normal office hours.
Copies of the previous Orders may be viewed at the Surrey County Council office specified above. In addition, plans detailing these restrictions may be viewed on-line at www.surreycc.gov.uk/tandridgeparking (follow the link to Tandridge parking review 2023).
If you wish to question the validity of any of the Orders or of any provision contained in any of those Orders on the grounds that it is not within the powers conferred by the Act, or on the grounds that any requirement of the Act or of any Instrument made under it has not been complied with in relation to any of the Orders, you may, within six weeks from the date of the making of the Order, apply to the High Court for this purpose.
Any reference to a road in the Schedules is a reference to part of the road only.
