NOTICE OF DETERMINATION
M5 JUNCTION 4A - 6 EMERGENCY AREA RETROFIT
ENVIRONMENTAL IMPACT ASSESSMENT DETERMINATION UNDER SECTION 105AB (1)(B) OF THE HIGHWAYS ACT 1980 (AS AMENDED)
National Highways gives notice that it has been determined that the M5 Junction 4a - 6 Emergency Area Retrofit proposal which is a relevant project within the meaning of section 105ZA (2) of the Highways Act 1980 (as amended) is not subject to environmental impact assessment in accordance with Part 105A of the Highways Act 1980 (as amended). This is due to the fact that there are no likely significant effects on the environment when taking into account the characteristics and location of the development, and the type and characteristics of the potential impacts. This conclusion has taken into account measures to avoid or prevent significant adverse effects on the environment including the following:
* Design of the scheme to facilitate avoidance of the potential for significant environmental impacts.
* The conclusion of a separate Habitat Regulations Assessment screening report which concluded that there was no requirement to carry out either the screening stage of Habitat Regulations Assessment or Appropriate Assessment for this project. The scheme is not in proximity to and would have no effect on any area subject to the Habitats Regulations.
* Construction using industry best practice methods which will be delivered via an Environmental Management Plan.
