1. NOTICE IS HEREBY GIVEN that the Council of the London Borough of Brent on 27th November 2023 made the above mentioned Orders under sections 6, 45, 46, 49 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984, as amended by section 8 of and Part I of Schedule 5 to the Local Government Act 1985, the Parking Acts of 1986 and 1989 and the Traffic Management Act 2004.
2. The general effect of the 'Disabled Persons Parking Places' Order will be to:-
(a) designate parking places in certain lengths of the streets specified in Schedule 1 to this Notice in which vehicles authorised by the Order may be left for any period without charge;
(b) provide that the parking places will operate "at any time";
(c) re-designate an existing free personalised parking place for vehicle displaying a Brent issued personalised disabled persons parking places permit to a free parking place for vehicles displaying a disabled person's badge (commonly referred to as "the Blue Badge") outside No. 69 Burrows Road, NW10 5SJ;
(d) specify, in respect of the parking places, that disabled persons' vehicles displaying in the relevant position a disabled person's badge (commonly referred to as "the Blue Badge") issued by any local authority under the provisions of the Disabled Persons (Badges for Motor Vehicles) (England) Regulations 2000 may be left therein;
(e) provide that certain vehicles may wait in the parking places in certain circumstances, e.g., to allow persons to board or alight (maximum 2 minutes), to load or unload (maximum 20 minutes), etc;
(f) revoke the existing, no longer required, disabled parking places outside No. 7 Acacia Avenue, HA9 7JF; 53 Ashford Road, NW2 6TT; 18 Bolton Gardens, NW10 5RD; 6 Doreen Avenue, NW9 7NX; 82 Fernbank Avenue, HA0 2TR; No. 139 Roundwood Road, NW10 9UI; 133 Sudbury Avenue, HA0 3BE and 7 Wotton Road, NW2 6PU;
(g) to make minor drafting amendments to the existing parking restrictions in certain roads to conform with the current on-site layout;
(h) defer the designation of the free disabled parking place outside No. 21 Thirlmere Gardens, HA9 8RH.
3. The general effect of the 'Free Permit Parking Places' Order will be to:
(a) designate free personalised parking places for vehicles displaying a Brent issued personalised disabled persons parking places permit issued under the Order in the streets specified in Schedule 2 to this Notice;
(b) provide that the parking places specified in Schedule 2 to this Notice will operate "at any time";
(c) re-designate existing free parking places for vehicles displaying a disabled person's badge (commonly referred to as "the Blue Badge") outside Bryan Avenue, adj. No. 30 Donnington Road, NW10 3QU; No. 6 Carlyle Road, NW10 8GG; No. 31 Chaplin Road, NW2 5PP; No. 265 Chapter Road, NW2 5LU; No. 3 Colin Road, NW10 2EE; 140 Mount Pleasant, HA0 1UE and 9 Wells Drive, NW9 8DH to free personalised parking places for vehicles displaying a Brent issued personalised disabled persons parking places permit issued under the Order;
(d) provide that a permit may be issued by the Council on application being made by a disabled person in possession of a Brent issued blue badge and:
(i) in receipt of the Disability Living Allowance with the higher rate of mobility component for an indefinite period; or
(ii) in receipt of the higher rate of Attendance Allowance for applicants aged 65 or over; or
(iii) where the applicant does not drive and has appointed a nominated carer to drive for them, the carer is in receipt of the Carer's Allowance award;
(e) revoke the existing, no longer required, personalised disabled parking places outside No. 4 Brook Avenue, HA9 8PH; Greenhill Road, adj. 24 Greenhill Park, NW10 9AP; Haydon Court, Haydon Close, NW9 0NS; No. 20 Milman Road, NW6 6EJ; 16 Montrose Crescent, Wembley, HAO 4YB; 14 Oxford Road, NW2 5SL; Park Place, adj. 91 Wembley Hill Road; 75 Pound Lane, NW10 2HU; Clarendon Court, Staverton Road, NW2 5HJ; 108 The Fairway, HAO 9TJ; 15 Thirlmere Gardens, HA9 8RH and 87 Wembley Hill Road, HA9 8BU;
(f) to make minor drafting amendments to the existing parking restrictions in certain roads to conform with the current on-site layout
(g) defer the designation of the free disabled permit parking places outside No. 93 Hilltop Avenue, NW10 8GP; No. 45 Albert Terrace, Milton Avenue, NW10 8PN and No. 2 Bathurst Gardens, NW10 5JA.
4. The general effect of the 'Parking Places Amendment' Orders will be to:-
(a) increase in length the existing permit parking places in Acacia Avenue, Ashford Road, Bolton Gardens, Fernbank Avenue, Roundwood Road, Sudbury Avenue and Wotton Road following the revocation of the no longer required personalised disabled persons parking places;
(b) increase in length the existing permit parking places in Brook Avenue, Greenhill Road, Haydon Close, Milman Road, Montrose Crescent, Oxford Road, Park Lane, Pound Lane, Silverton Road and Wembley Hill Road following the revocation of the no longer required personalised disabled persons parking places;
(c) reduce in length the existing permit holders parking places in Acland Road, Brenthurst Road, Brooksville Avenue, Chichele Road, Elgar Avenue, Hirst Crescent, Monks Park, Purves Avenue, Peter Avenue, Ravensworth Road, St. Margaret's Road, Thirlmere Gardens, Verney Street and Wotton Road to enable for the installation of disabled person's parking places specified in Schedule 1 to this Notice;
(d) reduce in length the existing permit holders parking places in Aylesbury Street, Bathurst Gardens, Beresford Avenue, Bramston Road, Bruce Road, Buchanan Gardens, Casselden Road, Chaplin Road, Chestnut Avenue, Churchmead Road, Cornwall Gardens, Donnington Road, Drayton Road, Hilltop Avenue, Larch Road, Malvern Road, Mitchellbrook Way, Park Lane, Purves Road, Rugby Avenue and Sandringham Road to enable for the installation of personalised disabled persons parking places specified in Schedule 2 to this Notice
5. The general effect of the 'Doctor Parking Places' Order will be to:-
(a) designate parking places (2 bays) outside WCHC Centre, Robson Avenue, for outside WCHC Centre, Robson Avenue, NW10 3RY;
(b) provide that:
(i) vehicles displaying a permit issued under the Order may be left in the parking place;
(ii) the parking place will be in operation between 8.30 a.m. and 6.30 p.m. Monday to Friday;
(iii) a permit may be issued by the Council on application being made by legally qualified medical practitioners;
(iv) the charge in connection with the issue of permits for the use of the parking place (which consists of one parking bay) will be £150 and that the permits will be valid for a period of 12 months.
6. Copies of the Orders, which will come into operation on 11 th December 2023, of maps of the relevant areas and of the above-mentioned Orders of 2001, 2008, 2019 and 2023 (and of any Orders which have amended those Orders) can be requested via email during normal office hours on Mondays to Fridays inclusive until the end of a period of 6 weeks from the date on which the Orders are made at Brent Customer Services, Brent Civic Centre, Engineers Way, Wembley, Middlesex, HA9 0FJ.
7. Any person desiring to question the validity of any of the Orders or of any provision contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984 or that any of the relevant requirements thereof or of any relevant regulations made thereunder has not been complied with in relation to any of the Orders may, within six weeks of the date on which any of the Orders were made, make application for the purpose to the High Court.
