Ar 24ain Hydref 2023 cadarnhawyd y Gorchymyn uchod a wnaethpwyd dan Adran 119 Deddf Priffyrdd 1980 gan Gyngor Sir Ynys Môn/Isle of Anglesey County Council.

Effaith y Gorchymyn fel y’i cadarnhawyd fydd gwyro llwybr troed cyhoeddus sy’n rhedeg:

O bwynt A (SH4781272122) sydd wedi’i leoli ar y briffordd sirol ychydig i’r de o’r hen felin wynt, mae’r llwybr yn mynd trwy giât i gwrtil Tyddyn. Mae’n parhau i’r de-orllewin heibio’r tŷ i wal isel ym mhwynt B, sy’n rhwystro’r llwybr. Mae’r llwybr yn parhau am ychydig ar lwybr caeedig i ddod i ben wrth giât cae presennol ym mhwynt C (SH477772060). Cyfanswm hyd y rhan o’r llwybr sydd i’w wyro yw tua 37M ac nid oes unrhyw led wedi’i gofnodi.

Mae’n parhau i’r de-orllewin ar hyd llwybr caeedig i orffen wrth giât cae bresennol ym mhwynt C (SH4777772060). Hyd y gwyriad yw tua 36M a’i led fydd 2M.

Daeth y Gorchymyn i rym ar y 24ain Hydref 2023, ond os oes person wedi’i dramgwyddo gan y Gorchymyn, ac yn amau ei ddilysrwydd, neu unrhyw ddarpariaethau a gynhwysir ynddo ar y sail nad yw o fewn pwerau Deddf Priffyrdd 1980 fel y’i diwygiwyd, neu ar y sail na chydymffurfiwyd â gofynion y Ddeddf, fel y’i diwygiwyd, neu reoliadau a wnaed fel canlyniad iddi, mewn perthynas â’r Gorchymyn, fe gall ef neu hi o dan baragraff 2 o Atodlen 2 i’r Ddeddf fel ei gymhwyswyd gan baragraff 5 o Atodlen 6 i’r Ddeddf, o fewn 6 wythnos i ddyddiad y rhybudd hwn wneud cais i’r Uchel Lys i’r perwyl hwnnw.

NOTICE OF CONFIRMATION OF PUBLIC PATH ORDER
HIGHWAYS ACT 1980
CYNGOR SIR YNYS MÔN / ISLE OF ANGLESEY COUNTY COUNCIL (FOOTPATH NO. 25 IN THE COMMUNITY OF LLANFIHANGEL ESCEIFIOG) PUBLIC PATH DIVERSION ORDER 2023

On 24th October 2023 Cyngor Sir Ynys Môn/Isle of Anglesey County Council confirmed the above Order made under Section 119 of the Highways Act 1980.

The effect of the Order as confirmed is to divert the Public Footpath running:
From point A (SH4781272122) situated on the county highway just south of the old windmill, the path proceeds through a gate into the curtilage of Tyddyn. It continues SW past the house to a low wall at point B, which obstructs the path. The path continues for a short distance on an enclosed trackway to end at an existing field gate at point C (SH4777772060). The total length of the path section to be diverted is approximately 37M and it has no recorded width.
to a line running:
From point D (SH4780472084) situated on the county highway between Tyddyn and Bryn Sunsur, the path proceeds SW for 5M to a gate at point E. It continues SW along an enclosed trackway to end at an existing field gate at point C (SH4777772060). The length of the diversion is approximately 36M and its width shall be 2M.

Alternatively, a copy of the Order and Order Map is available on the Council’s website www.anglesey.gov.uk/legal-orders. A hard copy of the Order and Order Map will be sent in the post free of charge on request if you contact SiwanJones@ynysmon.llyw.cymru or 01248 752591 (during normal office hours).

The Order came into force on the 24th October 2023, but if a person aggrieved by the Order wants to question its validity, or that any provision contained in it, on the grounds that it is not within the powers of the Highways Act, 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation under the Act has not been complied with in relation to the Order he or she may under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within 6 weeks from the date of this notice make an application to the High Court.
