Nelson Road And Empress Road Area - Application For An Order Stopping Up Of Highway

CITY OF NEWCASTLE UPON TYNE SECTION 116 HIGHWAYS ACT 1980
NOTICE OF APPLICATION FOR AN ORDER STOPPING UP OF HIGHWAY IN THE NELSON ROAD AND EMPRESS ROAD AREA
1. NOTICE IS HEREBY GIVEN that the Council of the City of Newcastle upon Tyne intends to apply to the Magistrates Court under Section 116 of the Highways Act 1980 for an order stopping up the areas of highway described below and shown delineated and shaded in red on map reference Drawing No. NR/TS/001 (“the Order map”) on the grounds that it is unnecessary. The highways to be stopped up are as follows:-
(a) The full extent of Nelson Road, commencing at point “A” on the Order map, being the junction between Nelson Road and Rendle Road (Grid reference E429635 N563635) and then running in a northerly direction for 284 metres, and then turning and running in an easterly direction for a further 96 metres to point “B” on the Order map (Grid reference E429752 N563909). This highway has a varying width of between 14 metres at its widest point and 7.7 metres at its narrowest point.
(b) The full extent of Empress Road, commencing at point “C” on the Order map, being the southern junction between Empress Road and Nelson Road (Grid reference E429634 N563676) and then running in a westerly direction for 38 metres, and then turning and running in a northerly direction for a 240 metres, before turning again and then running in an easterly direction for a further 22 metres to point “D” on the Order map being the northern junction between Empress Road and Nelson Road (Grid reference E429655 N563917). This highway has a varying width of between 12 metres at its widest point and 4 metres at its narrowest point.
(c) The unnamed area of highway being the footpath/steps linking Wincomblee Road and Empress Road, commencing at point “E” on the Order map being a point on Wincomblee Road (Grid reference E429617 N563923) and then running in an easterly direction for 20 metres to point “F” on the Order map being a point on Empress Road, at its north western corner (Grid reference E429635 N563918).
This highway has a width throughout of 2.3 metres.
(d) The unnamed area of highway being the footpath/steps linking Wincomblee Road and Empress Road, commencing at point “G” on the Order map being a point on Wincomblee Road (Grid reference E429587 N563716) and then running in an easterly direction for 3.75 metres to point “H” on the Order map being a point on Empress Road near the north western corner of unit 2 on the Walker Riverside Industrial Estate (Grid reference E429601 N563716). This highway has a width throughout of 2.3 metres.
(e) The unnamed area of highway being the footpath/steps linking Empress Road and Nelson Road, commencing at point “I” on the Order map, being a point located on Empress Road near the north west corner of the car parking area located between Empress Road and Nelson Road (Grid reference E429639 N563913) and then running in an easterly direction for 15 metres to point “J” on the Order map being a point on Nelson Road near the north eastern corner of the car parking area located between Empress Road and Nelson Road (Grid reference E429652 N563907). This highway has a varying width of between 2.8 metres at its widest point and 2.8 metres at its narrowest point.
2. The application is to be heard on 23rd November 2023 at 2pm in the Magistrates’ Court, Newcastle Law Courts, Quayside, Newcastle upon Tyne, NE1 2LA.
3. The effect of the Order sought will be to extinguish all highway rights over the highways subject to the application and prevent the passage of all traffic over them.
4. The Order and map may be inspected, free of charge at Customer Services, Central Library, Charles Avison Building, 33 New Bridge Street West, Newcastle upon Tyne, NE1 8AX between 10.00am and 4.30pm Monday to Friday. You may also email streetworks@newcastle.gov.uk or telephone (0191) 2787878 to request a copy of the documents.
5. Any person to whom this notice has been given or who uses the highways specified or who would be aggrieved by the making of the Order may appear before the Magistrates Court to raise an objection or to make representations on the application.
