GLOUCESTERSHIRE COUNTY COUNCIL
SECTION 116 HIGHWAYS ACT 1980 PROPOSED STOPPING UP OF PART OF UNCLASSIFIED ROAD NUMBER 40273 AT “HANOVER GREEN” IN THE PARISH OF REDMARLEY D’ABITOT

NOTICE is hereby given that an application will be made by Gloucestershire County Council as Highway Authority to the Magistrates’ sitting at Cheltenham Magistrates’ Court on the 16th of October 2023 at 10am for an Order to stop up all public highway rights (and downgrade part) over the area of land described in the Schedule hereto.

Any further representations or objections about this application can be put in writing and sent to either the Listing Clerk, HMCTS Gloucestershire, PO Box 9051, Gloucester, GL1 2XG or to the Assistant Director of Legal Services, Shire Hall, Westgate Street, Gloucester GL1 2TG (please quote reference S116/TA245/HanoverGreen).

The County Council will ensure that any representations or objections already received in this matter are brought to the attention of the Magistrates.

Alternatively, any person may attend the above hearing at Cheltenham Magistrates’ Court, 95 St George’s Road, Cheltenham GL50 3EW on the 16th of October 2023 at 10am.

Any person intending to appear before the Magistrates at the hearing is kindly requested to inform the Assistant Director of Legal Services, Shire Hall, Westgate Street, Gloucester GL1 2TG (please quote reference S116/TA245/ HanoverGreen) by the 9th of October 2023.

A plan illustrating the road which is the subject of the application may be inspected free of charge during the office opening hours at Gloucestershire County Council, Shire Hall, Gloucester, GL1 2TG (please quote reference S116/TA245), or alternatively at, Forest of Dean District Council, High Street, Coleford, GL16 8HG.

Schedule
Part I: Description of Highway to be Stopped Up
Subject to Part II below, the area of highway to be stopped up forms part of Unclassified highway no.40273 at “Hanover Green”, in the parish of Redmarley D’Abitot. The land is shown crosshatched on drawing number TA245.

The section under application is long and narrow in shape, extending from the A417 Ledbury Road near its junction with the road to Cobbs Cross (highway number 3/63) in a generally southerly direction to just north of the dwelling of Hanover Green Farm. It is approximately 215m in length and its width varies from between approx. 2.7m and 12.5m (as measured from modern maps).

Part II: Description of Public Footpath to be Reserved
A public footpath of approximately 8m in length and approximately 2m in width to be reserved over the section shown by the solid line on drawing number TA245, in order to provide a link between the existing length of Public Footpath GRA25 (shown by the dashed line) and the unaffected section of Unclassified highway 40273 to its south.
