What is happening?

CITY OF NEWCASTLE UPON TYNE
A. The City of Newcastle upon Tyne (On Street Parking Places) Order 2009 (Cashless Parking Variation) Order 2023
1. NOTICE IS HEREBY GIVEN that on 7th September 2023 the Council of the City of Newcastle upon Tyne made an Order under Sections 32, 35, 45, 46, 49, 53, 63 and Part IV of Schedule 9 of the Road Traffic Regulation Act 1984 which amends the City of Newcastle upon Tyne (On Street Parking Places) Order 2009 (“the 2009 Order”).
2. The effect of the Order, which will come into operation on 3rd October 2023, is to -
 (a) provide a facility at all on street charged parking places to pay by credit card or debit card at a ticket machine, and
 (b) provide a facility at all on street charged parking places which do not currently have the service, to pay the parking charge by telephone using the PayByPhone service
 There are charged on street parking places in the roads specified in Schedule 1 to this Notice.
 These new payment methods are in addition to the existing payment methods, including payment by way of coins, but the Order will provide that the applicable payment methods will be dictated by the ticket machine that is present in each location. With coming-into-force of this Order, the Council will start a programme of works to roll out upgrades to ticket machines over a period of time; this will either result in new machines which will no longer accept coins, or existing ticket machines being reconfigured to no longer accept coins.

B. The City of Newcastle upon Tyne (Off Street Parking Places) Order 2021 (Cashless Parking Variation) Order 2023
1. NOTICE IS HEREBY GIVEN that on 7th September 2023 the Council of the City of Newcastle upon Tyne made an Order under Sections 32, 35 and Part IV of Schedule 9 of the Road Traffic Regulation Act 1984 which amends the City of Newcastle upon Tyne (Off Street Parking Places) Order 2021 (“the 2021 Order”).
2. The effect of the Order, which will come into operation on 3rd October 2023 is to provide a facility at off street charged parking places, which do not currently have this method of payment, to pay by credit card or debit card.
 The ‘Pay by Phone’ facility for payment of the parking charge will remain available as an alternative method of payment.
 The charged off street parking places (car parks) are specified in Schedule 2 to this Notice.
 These new payment methods are in addition to the existing payment methods, including payment by way of coins, but the Order will provide that the applicable payment methods will be dictated by the ticket machine that is present in each location. With coming-into-force of this Order, the Council will start a programme of works to roll out upgrades to ticket machines over a period of time; this will either result in new machines which will no longer accept coins, or existing ticket machines being reconfigured to no longer accept coins.

If you wish to question the validity of the above Orders or of any of their provisions on the grounds that it or they are not within the powers conferred by the Act or that any relevant requirements have not been complied with in relation to the Orders you may, within six weeks from 7th September 2023, apply to the High Court for this purpose.
