What is happening?

WEST BERKSHIRE DISTRICT COUNCIL

(SCHOOL STREETS – FRANCIS BAILY PRIMARY SCHOOL,  THATCHAM) (PROHIBITION OF DRIVING (EXPERIMENTAL)) ORDER 2O23 The Council has made an order under Sections 9 and 10 of and to the Road Traffic Regulation Act 1984 [“the Act”] the effect of  which is to prohibit all motor vehicles from proceeding as follows:

IN THE TOWN OF THATCHAM

Monday to Friday 08:15-09:15 and 14:30-15:30 during school term time only Road Names Extent Edwin Close, Jedburgh Close and  Skillman Drive  For their entire lengths

The Order will contain exemptions to the Proposal as follows: 

(a) It is being used for the mechanical cleansing, maintenance, servicing, improvement or reconstruction of the Roads; or (b) it is being used for the laying, erection, alteration or repair  in the Roads or any sewer, or any main, pipe or apparatus  for the supply of gas, water, oil or electricity or of any  communications apparatus as defined in paragraph 1 of Schedule 2 to the Telecommunications Act 1984 and Sections 106 and 151 of the Communications Act 2003; or (c) it is being used for Fire and Rescue, Police, Ambulance, and doctors on call, Healthcare Workers (including district  nurses, personal carers and support workers) or other  service purposes registered with a valid virtual permit  unless in an emergency; or

(d) it is being used for the service of the local authority or water authority in pursuance of their statutory powers or duties in connection with its activities at premises situated on the Roads; or

(e) it is displaying a valid disabled badge and is registered with a valid virtual permit, being driven by or carrying a disabled person to uplift or set down passengers or to wait at a property or premises on the Roads

(f) it is displaying a valid Permit; or

(g) it is being used for the removal of any obstruction to traffic on the Roads

(h) Private Delivery vehicles and private hire vehicles serving a property within the School Street (1 Day exemption) (i) People/Services supporting a resident to maintain an independent lifestyle

(J) Emergency utility repairs including but not limited gas electric water and oil

(k) Emergency structural repairs

(l) Building and utility works related works which cannot avoid the restricted times

(m) Visitors visiting a property or school which cannot avoid the restricted times

The Council will be considering in due course whether the provisions of the Order should be continued in force indefinitely. Within the period of the Order [Eighteen months] from the 22 August 2023 (or if the Order is subsequently varied by another  Order under Section 9 of the Act or modified pursuant to  sub-section (2) of Section 10 of the Act from the coming into operation of that variation or modification whichever is the latest) any person may object [within six months of the Notice date] to the making of any Order for the purposes of such indefinite continuation. Any such objection must be in writing and must  give the grounds on which it is made and must be sent to the undersigned quoting reference 009051MS. 

Copies of the Order, explanatory statement and maps can be inspected during the hours of 9.00 a.m. to 4.30 p.m. Mondays to Fridays at the offices of West Berkshire District Council (at main reception on the ground floor), Council Offices Market  Street Newbury Berkshire RG14 5LD and on the Council’s website at www.westberks.gov.uk/consultations

If you wish to question the validity of the Order or any provisions contained in it on the grounds that it is not within the powers conferred by the Road Traffic Regulation Act 1984 or on the grounds that any requirement of that Act or any instrument under it has not been complied with in relation to the Order, you may, within six weeks from the 24 August 2023 apply to the High Court  for this purpose.
