Mae’r Gweinidog Newid Hinsawdd, un o Weinidogion Cymru, yn rhoi hysbysiad o dan baragraff 20(5) o Atodlen 3 i Ddeddf Harbyrau 1964 (“y Ddeddf”) o’i phenderfyniad o dan baragraff 19(6) o Atodlen 3 i’r Ddeddf i wneud, gydag addasiadau, Gorchymyn Diwygio Harbwr Caergybi 2023.
Gwnaed cais am y Gorchymyn gan Stena Line Ports Limited (“Stena”) o dan adran 14 o’r Ddeddf. Mae’r Gorchymyn yn awdurdodi Stena i adeiladu a chynnal gweithfeydd yn Harbwr Caergybi yn Sir Ynys Môn. Mae hefyd yn awdurdodi adeiladu gweithfeydd atodol ac yn rhoi pwerau i garthu at ddibenion adeiladu a chynnal y gweithfeydd. Yn ogystal, mae’r Gorchymyn yn rhoi pwerau mewn perthynas â rhoi cyfarwyddydau cyffredinol ac arbennig o fewn Harbwr Caergybi. HARBOURS ACT 1964 (AS AMENDED) THE HOLYHEAD HARBOUR REVISION ORDER 2023
The Minister for Climate Change, one of the Welsh Ministers, gives notice under paragraph 20(5) of Schedule 3 to the Harbours Act 1964 (“the Act”) of her decision under paragraph 19(6) of Schedule 3 to the Act to make with modifications the Holyhead Harbour Revision Order 2023.
The Order was applied for by Stena Line Ports Limited (“Stena”) under section 14 of the Act. The Order authorises Stena to construct and maintain works at Holyhead Harbour in the County of Anglesey. It also authorises the construction of subsidiary works and confers powers to dredge for the purposes of constructing and maintaining the works. In addition the Order confers powers in relation to the issuing of general and special directions within Holyhead Harbour. The Minister for Climate Change has given notice of her determination by way of a decision letter, dated 3 August 2023, copies of which may be obtained from Decisions Branch, Planning Directorate, Welsh Government, Crown Buildings, Cathays Park, Cardiff CF10 3NQ, Planning.Directorate@gov. wales. The decision letter is also available at https://planningcasework.service.gov.wales/ - search for 3234821. The letter gives the reasons for the determination; the considerations upon which it is based; information about the public participation process; and information regarding the right to challenge the validity of the determination and the procedures for doing so.
The Minister for Climate Change confirms that, before making her determination, she considered the reasoned conclusion of the environmental statement provided by the applicant and all objections and representations relating to it, and that she otherwise complied with the obligations referred to in paragraph 19(1) of Schedule 3 to the Act.
