Amendments to Waiting and Loading Restrictions And On-Street Parking Places in the Borough of Epsom and Ewell
On 21 March 2023 Surrey County Council made, with modification, the following Orders pursuant to Sections 1, 2, 3, 4, 32, 35, 36, 45, 46, 49, 51 and 53 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984: -1. "The Surrey County Council (Various Roads in Epsom and Ewell) Amendment of Waiting Loading and Unloading Prohibition and On-Street Parking Places Orders) (Amendment No.7) Order 2023" The purpose of which is to amend the following Orders: (1) The Surrey County Council (Various Roads in Epsom and Ewell) (Consolidation of Free Street Parking Places and Revocation) Order 2018; (2) The Surrey County Council Various Roads in The Borough of Epsom and Ewell (Consolidation of Permit Holders Only) (On-Street Parking Places) Order 2018; (3) The Surrey County Council (Various Roads in Epsom and Ewell) (Consolidation and Revocation of Prohibition of Stopping Outside Schools) Order 2018; (4) The Surrey County Council (Various Roads in Epsom and Ewell) (Revocation and Consolidation of Waiting, Loading and Unloading Prohibition and Restriction) Order 2018; (5) The Surrey County Council (Various Roads in Epsom and Ewell) (Consolidation and Revocation of Free Street Parking Places) (Disabled Persons) Order 2018. So as to: -
(a) prohibit waiting by vehicles in certain lengths of the roads specified in the First Schedule to this Notice, on the days and at the times indicated in the said Schedule; Exemptions for loading on and unloading from vehicles, boarding and alighting from vehicles, using vehicles for works on or adjoining the lengths of roads referred to in the First Schedule, the maintenance of those roads and the services in them and for disabled persons' vehicles in accordance with the Blue Badge Scheme, will apply to the afore-mentioned restrictions;
(b) revoke the existing waiting restrictions in certain lengths of the roads specified in the Second Schedule to this notice, during the times and on the days specified in the said Schedule, without replacement.
(c) prohibit the stopping of vehicles outside schools, as indicated by zig-zag markings on site, in a certain length of Church Street, Ewell, applying Monday to Friday (inclusive) between 8.15am and 9.15am and between 2.30pm and 4pm.
(d) Extend the stopping of vehicles outside school's prohibition, in a certain length of Rosebank, Epsom, between 8.15am-9.15am and 2.30pm-4pm every day as indicated by zig-zag markings on site.
(e) the usual exemptions shall apply, namely any person causing a vehicle to stop in order to avoid an accident if required to do so by law; anything done with the permission of a police constable in uniform or in accordance with a sign placed by Surrey Police in accordance with Section 66 and/or 67 of the Act; or any vehicle which is displaying a valid waiver certificate issued by the Council
(f) provide such free disabled persons on-street parking place in the lengths of roads specified in Third Schedule to this Notice, to be operational at all times without limit of time
(g) revoke the existing disabled persons on-street parking place in Ewell By-Pass Service Road outside No.106 to be replaced with a permit parking place for Permit Parking Zone"X".
(h) provide that certain other vehicles may wait in the on-street parking places described above in certain circumstances e.g. to allow persons to board or alight (maximum 2 minutes), to load or unload (maximum 20 minutes), etc.;
(i) provide that in the case of any of the on-street parking places specified above, outside the hours of operation indicated in the said Schedules, any vehicle may be left in any of those on-street parking places for any period without time limit
(j) revoke a section at the north-western end of the residents permit parking bay on Chalk Lane equal to one car length and provide an extension to the same resident permit parking bay at the south-eastern end equal to one car length.
(k) include the residents of property number 31 Prospect Place, Epsom, to be eligible for permits in Permit Parking Zone "E".
N.B costs and conditions of use:
(i) the vehicles which may be left in the parking place, during the hours of operation shall be vehicles displaying a valid parking permit bearing the appropriate identifying letter;
(ii) provide residents' parking permits for residents of the said properties, which will allow them to park in the said on-street permit holders' only parking place during the hours of operation. Such permits will cost £80 for the first permit, £100 for a second permit and £130 for any subsequent permit (as applicable) and will be valid for a period of twelve months. These charges will rise by £4 on the 1st of January on each of 2024, 2026, and 2028. The charge for a duplicate permit or a change of permit due to the change of vehicle will be £15;
(iii) provide that such residents parking permits shall be allocated using the following calculation: the sum of the number of vehicles registered to the place of abode minus the number of off-street parking places for such place of abode;
(iv) provide for: (1) residents to purchase permits for use by their visitors at a cost of £2 each, which will be valid for one day, subject to a limit of 150 pa, or £1 which will be valid for 2 hours limited to 250 pa; (2) Operational Permits, for use by doctors and nurses, and Carers Permits, for carers and community care personnel who are required to make visits to residents, which will be free of charge; and (3) Child Care Permits, for persons employed to visit a resident for the purpose of child care, pursuant to a contract of employment, will incur the same cost as a resident's permit, dependant on how many permits the resident has already been issued
(l) include the residents of property number 27A High Street, Epsom to be eligible for permits in Permit Parking Zone "G". The costs and conditions of use will be the same as in sub-paragraph (1)(j) above (m) include the residents of property number 34 Ashley Road, Epsom to be eligible for permits in Permit Parking Zone "J". The costs and conditions of use will be the same as in sub-paragraph (1)(j) above
(n) include the residents of property numbers 2, 4 and 6 West Hill, Epsom to be eligible for visitors permits in Permit Parking Zone "R". The costs and conditions of use will be the same as in sub-paragraph above (o) make provision for virtual permits for all permit schemes in the Borough
(p) Make certain drafting amendments to the following existing Orders which impose waiting, loading and unloading and parking prohibitions and restrictions in the Borough of Woking, which will not affect the operation of those prohibitions and restrictions:- (1) The Surrey County Council Hookfield and Lindsay Close Controlled Parking Zone in The Borough of Epsom and Ewell (Consolidation of Wating Restrictions And On-Street Parking Places) Order 2018; (2) The Surrey County Council (Various Roads in Epsom and Ewell) (Consolidation of Free On-Street Loading Bays and Goods Vehicles' Free On-Street Loading Bays) Order 2018
2. The Surrey County Council (Various Roads in the Borough of Epsom and Ewell) Electric Vehicle Parking Places Order 202-, which will (a) introduce such electric vehicle on-street parking places in certain lengths of the roads specified in the Fourth Schedule to this Notice to be used at the times and on the days specified therein by electric vehicles or hybrid vehicles for the purpose of charging the said vehicle by use of the electric charging post installed in respect of that parking place; (b) certain other vehicles may wait in such parking places in certain circumstance e.g. to allow persons to board or alight (maximum 2 minutes) to load or unload (maximum 20 minutes), etc. but no exemption shall apply to blue badge holders.
3. The Surrey County Council Various Roads in the Borough of Epsom and Ewell (On-Street Car Club Parking Places) Order 202-, which will (a) introduce such on-street parking places for the parking of a car club vehicle only which displays a car club permit for the specified car club vehicle and car club bay location. The car club bay will be in operation for 24 hours, Monday to Sunday in a certain length of St Martins Avenue; (b) such restrictions being subject to the same exemptions specified in paragraph 2(b) above. N.B blue badge holders will not be exempt from these restrictions.
Where a restriction is proposed herein any existing restriction on the same length of road will be revoked, unless otherwise indicated. A copy of the made Orders, which will come into operation on 01 April 2023, plans showing the lengths of roads to which the Orders relate and a Statement of the Council's reasons for making the Orders may be inspected, free of charge, at (a) Surrey County Council, Merrow Complex, Merrow Lane, Merrow, Guildford, GU4 7BQ, Monday to Friday 8.30am to 4.30pm; (b) Epsom Town Hall, The Parade, Epsom, KT18 5BY, during normal office hours; (c) Epsom Library, Ebbisham Centre, No. 6 Derby Square, Epsom, KT19 8AG; (d) Bourne Hall Library, Spring Street, Ewell, KT17 1UF; (e) Stoneleigh Library, No. 1 Stoneleigh Broadway, Stoneleigh, KT17 2JA; and (f) Ewell Court Library, Ewell Court House, Lakehurst Road, Ewell, KT19 0EB. Copies of the previous Orders may be viewed at the Surrey County Council office specified above. In addition, plans detailing these restrictions may be viewed on-line at www.surreycc.gov.uk/epsomandewellparking (follow links to Epsom and Ewell Parking Review 2023). If you wish to question the validity of any of the Orders or of any provision contained in any of those Orders on the grounds that it is not within the powers conferred by the Act, or on the grounds that any requirement of the Act or of any Instrument made under it has not been complied with in relation to any of the Orders, you may, within six weeks from the date of the making of the Order, apply to the High Court for this purpose.
Any reference to a road in the Schedules is a reference to part of the road only.
