PROPOSED SMOKE CONTROL ORDER 2026

NOTICE is hereby given that Brighton & Hove City Council (‘the Council’) proposes to make the Brighton & Hove City Council Smoke Control Order 2026 under section 18 of the Clean Air Act 1993.

The effect of the proposed Order would be to declare the whole urban administrative area of the Council a smoke control area for the purposes of Part III of the Clean Air Act 1993. The proposed Order includes specified exemptions. The proposed Order includes moored vessels located within Brighton & Hove, Marina, or docked at Wharfs.

NOTICE is also given that the Council has made the Brighton & Hove City Council Smoke Control (Revocation) Order 2026, which was confirmed by the Secretary of State on 22 September 2026. The Revocation Order will revoke the existing smoke control orders applying within the Council’s area, including those listed in Schedule 1 to the Revocation Order and will come into effect not earlier than 6 months after confirmation.

Copies of the proposed Order, the Revocation Order and the relevant plan may be inspected free of charge at Brighton Town Hall, Bartholomew Square, Brighton BN1 1JA, Hove Town Hall, Norton Road Hove BN3 4AH, receptions and at Council libraries during normal opening hours for a period of 6 weeks from the date of the last publication of this Notice. Objections to the proposed Order may be made by notice in writing to Brighton & Hove City Council, Hove Town Hall, Norton Road, Hove BN3 3BQ, or by email to EHL.EnvironmentalProtection@brighton-hove.gov.uk, within six weeks of the date of the last publication of this notice.
