Notice of Definitive Map Modification Order
Wildlife and Countryside Act 1981 - Section 53
The Definitive Map and Statement for the Former Kerrier District Area
On 25August 2026, Cornwall Council confirmed the above Order made under section 53(2)(b) of the Wildlife and countryside Act 1981. The effect of the Order as confirmed is to modify the Definitive Map and Statement for the area by:
i) Adding a length of Restricted Byway in the Parish of Breage commencing at Byway Open to All Traffic 18 St Hilary approximately 114 metres east-north-east of 'Greenacres' at OSGR SW 5585/2919, then running in a generally southerly direction for a distance of 10 metres, to its junction with Byway Open to All Traffic 16 St Hilary at OSGR SW 5584/2918, then running in a generally southerly then south-southwesterly direction for a distance of 204 metres terminating at its junction with Footpath 55 Breage to be upgraded to Restricted Byway by this Order, approximately 171 metres south-south-east of 'Greenacres' at OSGR SW 5579/2899
ii) Adding a length of Restricted Byway in the Parish of Breage commencing at its junction with Footpath 55 Breage to be upgraded to Restricted Byway by this Order, approximately 200 metres south-south-east of 'Greenacres' at OSGR SW 5580/2897, then running in a generally westerly then west-south-westerly direction for a distance of 192 metres terminating at its junction with Footpath 75 Breage approximately 263 metres south-south-west of 'Greenacres' at OSGR SW 5562/2892.
iii) Upgrading a length of existing Footpath 55 in the Parish of Breage to Restricted Byway commencing at its junction with another Restricted Byway to be added by this Order, approximately 171 metres south-south-east of 'Greenacres' at OSGR SW 5579/2899, then running in a generally south-south-easterly direction for a distance of 33 metres to its junction with another Restricted Byway to be added by this Order at OSGR SW 5580/2897, then running in a generally easterly then south-easterly direction for a distance of 255 metres terminating at its junction with Unclassified Road U6021 approximately 407 metres south-east of 'Greenacres' at OSGR SW 5603/2888.

A copy of the Order and Map has also been placed and may be seen free of charge at Hayle Library and Information Service, Commercial Road, Hayle TR27 4DE from 9:30am to 5:00pm on Monday, Tuesday, and Friday, and from 9:30am to 12:30pm on Saturday. A copy may also be viewed at the Offices of Cornwall Council at New County Hall, Treyew Road, Truro, TR1 3AY on 9.00 am to 5.00 pm on Monday to Friday (Bank Holidays excepted).
The Order came into force on the day that it was confirmed but if any person aggrieved by the Order wants to question its validity on the ground that it is not within the powers of Section 53 of the Wildlife and Countryside Act 1981, or on the ground that any requirement of Schedule 15 of the Act has not been complied with in relation to the Order, he or she may under paragraph 12 (1) of Schedule 15 to the Act within six weeks from the date of this Notice, make application to the High Court.
