NOTICE OF CONFIRMATION PUBLIC PATH DIVERSION ORDER

(PART OF PUBLIC FOOTPATH NUMBER 160, BURY)

PUBLIC PATH DIVERSION AND

DEFINITIVE MAP AND STATEMENT MODIFICATION ORDER 2025

On 20 August 2026 the Secretary of State for Housing, Communities and Local Government confirmed with modifications the above Order made on 21 February 2025 under section 119 of the Highways Act 1980.

The effect of the Order as confirmed is to divert the path described in Schedule Part 1 to this notice and to create a new path described in Schedule Part 2 of this notice and as more particularly described in the Order and shown on the Order map.

A copy of the confirmed Order and the Order map may be requested to be sent by email at prowcconsult@bury.gov.uk and will also be available to view free of charge at the reception desk at Town Hall Bury BL9 0SW from 9:00 to 16:30, Monday to Friday.

This Order comes into force on the date which The Metropolitan Borough of Bury certify that the terms of Article 3 of the Order have been complied with but if any person aggrieved by the Order wants to question its validity or that of any provision contained in it on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of that Act, as amended, or any regulation made under the Act has not been complied with in relation to the Order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within 6 weeks from 10th September 2026, make an application to the High Court.

Schedule Part 1 – Description of site of existing path or way

East North East from Point A on the Order Plan (Grid Reference SD796136) along a farm access road, through Point C to Point B on the Order Plan (GR SD797137) before continuing along the access road towards Springside Road. The section of footpath is 107m in length and has a bituminous macadam surface.

Schedule Part 2 - Description of site of new path or way

The path leaves the farm access road at Point A on the Order Plan (GR SD796136) travelling in an east north east direction to the north of Walmersley Brook, through Point D on the Order Plan to return to the farm access road at Point B on the Order Plan (GR SD797137). The path is 111m in length and has a bituminous macadam surface with a width of 2m.
