What is happening?

Guildford Borough Council

Land known as Land lying to the South-West of Tilthams Corner Road, Godalming, hereafter entitled “The Land”

On the 8th and 9th October 2026, Guildford Borough Council (the Claimant) will be attending the High Court seeking a Final Injunction against the Land.

The Council is seeking a Final Order to confirm the prohibitory requirements already set out in the Interim Injunction Order of HHJ Walden-Smith (Sitting as a Judge of the High Court) relating to the Land (dated 13th November 2025) and to remedy the breach of planning control happening on the Land.

A Final Order will be sought against named defendants and also Persons Unknown as the Council considers an injunction to be necessary and expedient, and that there is compelling justification to include Persons Unknown in these circumstances.

Should you be personally affected by the injunction sought or have a genuine interest in the Land, including if you are considering occupying or buying any part of the Land in the future, you should be aware of the abovementioned proceedings.

The specific court room will be published in the afternoon on 7th October 2026 before the scheduled hearing on the Court’s website. Any breach of the existing Interim Injunction Orders and any Final Order may be pursued further by the Council through Contempt of Court proceedings. If found guilty of Contempt of Court you could face a fine or imprisonment.
