NOTICE IS HEREBY GIVEN THAT Salford City Council (the Council), in exercise of its powers under section 18 of, and Part III of Schedule 5 to the Clean Air Act 1993, as amended (“the Act”), (a) on 12th May 2026, made an Order entitled “THE SALFORD CITY COUNCIL SMOKE CONTROL ORDERS (REVOCATION) ORDER 2026” (THE REVOCATION ORDER); AND (B) PROPOSE TO MAKE AN ORDER ENTITLED “THE SALFORD CITY COUNCIL SMOKE CONTROL ORDER 2026” (the Proposed Order) declaring that the whole of the administrative area of the Council shall be a smoke control area for the purposes of the Act, subject to consideration by the Council of any objections, which are not withdrawn.

THE REVOCATION ORDER
The effect of the Revocation Order is to revoke existing smoke control orders put in place before November 1980 that are in operation in the administrative area of the Council set out in Schedule 1, subject to confirmation by the Secretary of State.

If confirmed, it will remove all smoke controls for those parts of the Council’s administrative area previously declared smoke control areas as set out in Schedule 1. If the Revocation Order is confirmed, with or without modification, it will not come into operation any earlier than six months from the date of confirmation by the Secretary of State.

THE PROPOSED ORDER
The Proposed Order if made by the Council would declare the whole of the administrative area of the council to be a smoke control area. This would effectively consolidate all previous orders into one city wide smoke control order and take into account boundary changes and redevelopment of areas that have occurred since the earlier orders commenced, and also bring moored vessels into scope. The effect of this would be that if, on any day after the Proposed Order comes into operation:-

1. smoke is emitted from a chimney of a building or a chimney which serves the furnace of any fixed boiler or industrial plant or chimney of a vessel moored within the administrative area of the Council, the person responsible, may be liable to a civil financial penalty of between £175 and £300, subject to any relevant objection on the grounds specified within Schedule 1A of the Act.

Note: Where smoke emissions are solely due to the use of the vessel’s engine to propel the vessel or to provide electric power to the vessel, the person liable shall not be subject to a civil financial penalty under schedule 1A of the Act.

2. Any person who acquires in England any controlled solid fuel for use in a building to which a smoke control order applies, a fireplace to which an order applies, or a fixed boiler or industrial plant to which an order applies, shall be guilty of an offence and liable on summary conviction to a fine not exceeding level 3 on the standard scale subject to relevant defences stated within the Act.

Note: The acquiring of controlled solid fuel for use in an approved fireplace shall not be an offence nor shall be the acquiring of controlled solid fuel for use in the propulsion of a vessel or to provide electric power to the vessel.

3. A person offers controlled solid fuel for sale by retail in England where the fuel is to be taken away by a purchaser, and fails to take reasonable steps to notify potential purchasers that it is an offence to acquire that fuel for use in a building to which a smoke control order applies, a fireplace to which an order applies, or a fixed boiler or industrial plant to which an order applies, shall be guilty of an offence and liable on summary conviction to a fine.

4. A person sells any controlled solid fuel by retail in England for delivery by that person, or on that person’s behalf, to a building to which a smoke control order applies, or premises in which there is any fixed boiler or industrial plant to which an order applies shall be guilty of an offence and liable on summary conviction to a fine subject to relevant defences stated within the Act.

Note: An “approved fireplace” (also known as an ‘approved appliance’, ‘exempt appliance’ or ‘Defra approved appliance’) means a fireplace of a type specified in a list published by the Secretary of State. The Secretary of State may only specify a type of fireplace in the list if satisfied that such a fireplace can, if used in compliance with any conditions specified in the list, be used for burning controlled solid fuel without producing any smoke or a substantial quantity of smoke.

“controlled solid fuel” means any solid fuel other than an approved fuel.

“approved fuel” means a solid fuel specified in a list which has been published by the Secretary of State for the purposes of this Act.

If the Proposed Order is made, it will come into operation on the date specified in the order being not less than six months after it is made, or such later date as the Council may specify.

A copy of the Orders and accompanying maps can be viewed free of charge from Monday - Friday 08:30 - 16:30 at the Council offices at: Salford City Council, Salford Civic Centre, Chorley Road, Swinton, M27 5AW during the period of 22nd June 2026 - 17th August 2026.

Any person who may be affected by the Proposed Order may object to its confirmation by giving notice in writing on or before 17th August 2026 to: Email: airquality@salford.gov.uk or Environmental Protection, Place Directorate, Salford City Council, Civic Centre, Chorley Road, Swinton, Salford. Objections to the confirmation of the Revocation Order must be sent to the Secretary of State on or before 17th August 2026 at: Email: Air.Quality@defra.gov.uk or Air Quality and Industrial Emissions, DEFRA, Seacole Building, 2 Marsham Street, London, SW1P 4DF.

All objections should be clearly headed ‘Objection to revision to Salford Smoke Control Orders’.
