NOTICE OF DEFINITIVE MAP MODIFICATION ORDER

THE METROPOLITAN BOROUGH OF BURY (UPGRADE TO RESTRICTED BYWAY OF FOOTPATH NO.23 ST ANDREWS, RADCLIFFE (HIGHER PIT LANE) AND PART OF FOOTPATH NO.10 CHRISTCHURCH, RADCLIFFE (CARR ROAD) IN THE BOROUGH OF BURY) ORDER 2026

The above Order was made on 14th May 2026 under section 53(3)(c)(ii) of the Wildlife and Countryside Act 1981. If confirmed as made the Order will modify the Definitive Map and Statement for Bury by:-

Public Footpath 23, St Andrews, Radcliffe (Higher Pit Lane) to be upgraded from footpath to restricted byway from its junction with Starling Road, approximately 470m south of Cockey Moor Road at Ordnance Survey Grid Reference (OSGR) SD7741 0993 at Point A on the Order Map (PRW/23SA/02), then in a westerly direction for 132m to the south west corner of house number 16, Higher Pit Lane, OSGR SD7727 0994 at Point B on the Order Map, then continuing westwards for 58m to a field gate where the path runs alongside a fence for 4m to a chicane ‘squeeze stile’ beside a field gate at OSGR SD7722 0994 at Point C on the Order Map. Continuing in a westerly direction around an area of spoil heaps for 290m to the path’s junction with Public Footpath 10, Christchurch, Radcliffe at a two-step stile at OSGR SD7694 0995 at Point D on the Order Map. From here, the route turns north along Public Footpath 10 Christchurch, Radcliffe for 103m to a two-step stile beside a field gate at the junction with Sumner Avenue, OSGR SD7692 1005 at Point E on the Order Map. The total length of the Footpath to be upgraded is 587m. The width varies between 6m and 7m.

A copy of the Order and Order map may be seen free of charge at the reception desk at Town Hall, Knowsley St Bury BL9 0SW from 9:30am – 4.30pm on weekdays (excluding bank holidays).

Any representation or objection relating to the Order must be sent in writing to the Head of Engineering and Street Scene, Public Rights of Way, at Bury Council, Bradley Fold Depot Unit 34, Bradley Fold Trading Estate Bradley Fold Road Bolton BL2 6RS or by email to prowconsult@bury.gov.uk by 2nd July 2026. Please state the grounds on which it is made. Please note that all representations received may be considered in public by the Council and that the substance of any representation together with the name and address of the person making it could become available for public inspection.

If no representations or objections are duly made to the Order or if any so made are withdrawn the Council may instead of submitting the Order to the Secretary of State may itself confirm the Order. If the Order is submitted to the Secretary of State any representations or objections which have been duly made and not withdrawn will be sent with it.
