Notice
Notice is hereby given that Berwick Bank Wind Farm Limited, registered under company registration SC721781 at Inveralmond House, 200 Dunkeld Road, Perth, Scotland, PH1 3AQ, has applied to the Scottish Ministers to vary the consent granted under section 36 of the Electricity Act 1989 on 31 July 2025 to construct and operate an offshore generating station known as Berwick Bank Wind Farm.
The application also seeks to vary the associated marine licences granted on 31 July 2025 under:
- Section 65 of the Marine and Coastal Access Act 2009, and
- Section 20 of the Marine (Scotland) Act 2010
These licences relate to:
- Offshore generating station (MS-00010189)
- Offshore transmission infrastructure (part 1) (MS-00010190)
- Offshore transmission infrastructure (part 2) (MS-00010191)
Purpose of Variation
The applications, made under:
- Section 36C of the Electricity Act 1989
- Section 72 of the Marine and Coastal Access Act 2009
- Section 30 of the Marine (Scotland) Act 2010
seek to:
- Allow discharge of conditions for each proposed phase of development, rather than for the development as a whole; and
- Correct discrepancies in the coordinates included in the offshore transmission infrastructure (part 1) and (part 2) licences.

Submissions must:
- Be dated
- Clearly state the name (in block capitals)
- Include a full return email or postal address
- Identify the proposal and specify grounds for objection or support
Public Local Inquiry
Where the Scottish Ministers decide to exercise their discretion, a Public Local Inquiry (PLI) may be held.
Determination Outcomes
Following consideration of all representations, the Scottish Ministers may:
For Section 36 consent:
- Grant variation (with or without conditions), or
- Refuse the variation
For marine licences:
- Vary the licences (with or without conditions), or
- Refuse the applications
Fair Processing Notice
MD-LOT determines applications under:
- Marine (Scotland) Act 2010
- Marine and Coastal Access Act 2009
- Electricity Act 1989 (Section 36)
Representations may include personal information (e.g. name, address), which will:
- Be used solely for determining the application
- Be stored securely in the Scottish Government’s corporate record
- Be shared with relevant parties (applicant, consultees, Directorate of Planning and Environmental Appeals if a PLI is held)
- Potentially be published online, with personal information removed
