DEDDF DIOGELU’R AMGYLCHEDD ADRAN 99

Hysbysir drwy hyn fod Cyngor Dinas Casnewydd wedi mabwysiadu’n ffurfiol Adran 99 o Ddeddf Diogelu’r Amgylchedd 1990, sy’n rhoi pwerau i awdurdodau lleol fynd i’r afael â throlïau siopa wedi’u gadael ar dir cyhoeddus.

Dan y ddeddfwriaeth hon, mae’r Cyngor bellach wedi’i awdurdodi i:

  • Dynnu trolïau sydd wedi’u gadael o briffyrdd cyhoeddus a thir sy’n eiddo i’r cyngor.
  • Storio trolïau atafaeledig am hyd at chwe wythnos.
  • Hysbysu’r perchennog o fewn saith diwrnod ar ôl eu symud.
  • Codi ffi o £100 am ddychwelyd pob trol
  • Gwaredu trolïau heb eu hawlio ar ôl chwe wythnos.

Nod y polisi hwn yw mynd i’r afael â’r broblem gynyddol o drolïau sydd wedi’u gadael, sy’n cyfrannu at lygredd gweledol, ymddygiad gwrthgymdeithasol, difrod amgylcheddol ac yn peri perygl i fywyd gwyllt a defnyddwyr.

Anogir manwerthwyr i roi mesurau atalol ar waith er mwyn sicrhau bod trolïau yn aros ar eu safle. Bydd y Cyngor yn parhau i weithio gyda busnesau a thrigolion i leihau effaith trolïau wedi’u gadael ledled y ddinas.

Bydd refeniw a gynhyrchir o’r polisi hwn yn cael ei ail-fuddsoddi mewn mentrau gorfodi a gwella amgylcheddol, gan gynnwys ymgyrchoedd yn erbyn tipio anghyfreithlon a thaflu sbwriel.

Mabwysiadodd Cyngor Dinas Casnewydd Atodlen 4 i Ddeddf Diogelu’r Amgylchedd 1990 yn ffurfiol ar 16 Hydref 2025. Yn unol â’r ddeddfwriaeth, bydd y darpariaethau’n ymwneud â rheoli trolïau siopa wedi’u gadael yn dod i rym dri mis o’r dyddiad mabwysiadu, 16 Ionawr 2025. Mae’r cyngor hwn yn caniatáu digon o amser i bartïon yr effeithir arnynt, gan gynnwys manwerthwyr, wneud trefniadau i gydymffurfio â’r gofynion newydd.

NOTICE OF ADOPTION OF SECTION 99

ENVIRONMENTAL PROTECTION ACT:

ABANDONED SHOPPING TROLLEYS

NEWPORT CITY COUNCIL (“THE COUNCIL”)

ENVIRONMENTAL PROTECTION ACT SECTION 99

Notice is hereby given that Newport City Council has formally adopted Section 99 of the Environmental Protection Act 1990, which provides local authorities with powers to deal with abandoned shopping trolleys found on public land.

Under this legislation, the Council is now authorised to:

  • Remove abandoned trolleys from public highways and council-owned land.
  • Store seized trolleys for up to six weeks.
  • Notify the owner within seven days of removal.
  • Charge a £100 fee for the return of each trolley.
  • Dispose of unclaimed trolleys after six weeks.

This policy aims to address the growing problem of abandoned trolleys, which contribute to visual pollution, antisocial behaviour, environmental damage, and pose risks to wildlife and waterways.

Retailers are encouraged to implement preventative measures to ensure trolleys remain on their premises. The Council will continue to work with businesses and residents to reduce the impact of abandoned trolleys across the city.

Revenue generated from this policy will be reinvested into enforcement and environmental improvement initiatives, including campaigns against fly-tipping and littering.

Newport City Council formally adopted Schedule 4 of the Environmental Protection Act 1990 on 16th October 2025. In accordance with the legislation, the provisions relating to the management of abandoned shopping trolleys will come into effect three months from the date of adoption, 16th January 2025. This period allows affected parties, including retailers, sufficient time to make arrangements to comply with the new requirements.
