What is happening?

RHYBUDD CYHOEDDIAS AM Y CYNLLUN TRWYDDEDU YCHWANEGOL

Mae rhybudd nawr yn cael ei rhoi bod Cyngor Sir Ddinbych ar 21ain Hydref 2025 wedi dynodi cynllun trwyddedu ychwanegol mewn perthynas â Thai Amlfeddiannaeth trwy gydol Sir gyfan. Gelwir y cynllun hwn yn Gynllun Trwyddedu Ychwanegol (Tai Amlfeddiannaeth) Cyngor Sir Ddinbych 2025 (“y Cynllun”). Mae’r dynodiad yn unol â Rheoliadau Trwyddedu a Rheoli Tai Amlfeddiannaeth a Thai Efallai (Darpariaethau Amrywiol) (Cymru) 2006.

Mae’r Cynllun y mae’r dynodiad yn berthnasol iddo wedi cael Cymeradwyaeth Gyffredinol Llywodraeth Cymru o dan Ddeddf Tai 2004 (Trwyddedu Ychwanegol Tai Amlfeddiannaeth Cymru) Cymeradwyaeth Gyffredinol 2007 a ddaeth i rym 13eg Mawrth 2007. Felly, yn rhinwedd Adran 58 isadrannau (1) (b) a (7) nid oes angen cana brihau’r dynodiad a daw i rym ar ddyddiad sydd wedi’i nodi yn y Dynodiad. Bydd y Cynllun yn gweithlio yng ngha Cynllun Trwyddedu Gorfodol Tai Amlfeddiannaeth yn yr Awdurdod Lleol a ddaeth i rym ar 30 Mehefin 2006. Daw’r Cynllun i rym ar 1af Chwefror 2026 ac os na fydd wedi’i ddiddymu cyn hynny neu ei ymestyn fe ddaw i ben ar 31ain Ionawr 2031.

Mae’r Cynllun yn cynnwys yr holl Dai Amlfeddiannaeth yn yr ardal sydd wedi’i nodi uchod ac y bydd yn cynnwys tai sy’n cwrdd â’r holl feini prawf o fewn y naill neu’r llall o’r ddau gategori canlynol:

(a) Unrhyw fath o Dy Amlfeddiannaeth a ddiffinnir gan Adran 254 o Ddeddf Tai 2004 nad yw’r cynllun trwyddedu gorfodol yn gymwys iddo, a feddiannir gan dri neu fwy o bobl sydd wedi’u rhannu’n ddy aelod wye neu fwy.

(b) Tai Amlfeddiannaeth a ddiffinnir o fewn cwmpas Adran 257 Ddeddf Tai 2004; Tai Amlfeddiannaeth a gyfnewir trwy addasu adeiladau’n fflatiau, ond nad ydynt yn cwrdd â Rheoliadau Adeiladu 1991 ac sydd heb eu gwella’n unol â’r safonau perthnasol ers hynny.

Ni fydd y Cynllun yn cynnwys Tai Amlfeddiannaeth sydd wedi’u heithrio gan adrannau perthnasol o’r Ddeddf a’r rhai sydd eisoes wedi’u trwyddedu dan y Cynllun Trwyddedu Gorfodol Tai Amlfeddiannaeth.

Dylai pob landlord sydd yn berchenong eiddo yn yr ardal sydd wedi’i henwi ac sydd yn disgyn o fewn un o’r meini prawf uchod wneud cais am drwydded. Codir Ffioedd ac Amodau i gyd fynd â’r Cynllun. Bydd methiant i wneud cais am drwydded pan fo angen yn drosedd o dan Adran 72 o Ddeddf Tai 2004. Mae person sy’n cyflawni tramgwydd yn atebol ar golffarn ddiannod i ddirwy ddiderfyn. Dylai pob perchennog, landlord neu asiant yn yr ardal sydd wedi’i henwi, ofyn cyngor yr Awdurdod Lleol ynghlyn â Thrwyddedu Tai Amlfeddiannaeth. Er mwyn i gais gael ei ystyried, rhaid darparu manylion rhagonedig a’r tal gofynnol.

HOUSES IN MULTIPLE OCCUPATION (HMOS) AND THE HOUSING ACT 2004

PUBLIC NOTICE IN RESPECT OF ADDITIONAL LICENSING

Notice is hereby given that Denbighshire County Council has on the 21st October 2025 designated a county wide Additional Licensing Scheme in respect of Houses in Multiple Occupation. The scheme will be known as the Denbighshire County Council Additional Licensing (Houses in Multiple Occupation) Scheme 2025 (“The Scheme”). The designation is in accordance with the Licensing and Management of Houses in Multiple Occupation and Other Houses (Miscellaneous Provisions) (Wales) Regulations 2006.

This Scheme to which the designation applies has General Approval of the Welsh Government under the Housing Act 2004 (Additional HMO Licensing Wales) General Approval 2007 of which came into force on 13th March 2007. Accordingly, by virtue of Section 58 subsections (1) (b) and (7) the designation need not be confirmed and will come into effect on a date specified in the Designation. The Scheme will work in conjunction with the Local Authority’s Mandatory Licensing of Houses in Multiple Occupation Scheme which came into force on 30th June 2006. The Scheme will be effective from 1st February 2026 and unless revoked beforehand or extended will cease to have effect on 31st January 2031.

The Scheme shall be applied to all Houses in Multiple Occupation (HMOs) within the area described above and will include properties that meet all of the criteria, within either one of the following two categories:

(a) Any type of HMO as defined by Section 254 of the Housing Act 2004 which does not fall within the mandatory licensing scheme, occupied by three or more persons, forming two or more households.

(b) HMO properties which are defined within the scope of Section 257 of the Housing Act 2004; HMO’s created by converting buildings into flats, but do not meet the 1991 Building Regulations and they have not been subsequently brought up to the relevant standards.

The Scheme shall not be applied to those properties exempted by relevant sections of the Act and those already licensed under the Mandatory Licensing of Houses in Multiple Occupation Scheme.

All landlords who own a property that fall under either one of the above criteria will have to apply for a licence. Fees and Conditions will be applicable to the Scheme. Failure to apply for a licence where required is an offence under Section 72 of the Housing Act 2004. A person who commits an offence is liable on summary conviction to an unlimited fine. All owners, landlords or agents of properties within the designated area should seek advice from the Local Authority regarding Licensing of Houses in Multiple Occupation. For an application to be considered, it must provide the prescribed particulars and it must be accompanied by the requisite fee.
