What is happening?

DESIGNATION OF AN AREA FOR ADDITIONAL LICENSING

SECTION 56, HOUSING ACT 2004

Peterborough City Council in exercise of its power under section 56 of the Housing Act 2004 (“the Act”) and in accordance with the Licensing of Houses in Multiple Occupation and Selective Licensing of Other Residential Accommodation (England) General Approval 2015 hereby designates for additional licensing the area described in paragraph 4

CITATION, COMMENCEMENT AND DURATION

1.  This designation may be cited as the Peterborough City Council Designation of an Area for Additional Licensing 2025.

2.  This designation is made on 15 October 2025 and shall come into force on 26 January 2026

3.  This designation shall cease to have effect on 25 January 2031 or earlier if the Council revokes the scheme under section 60 of the Act

AREA TO WHICH THE DESIGNATION APPLIES

4.  This designation shall apply to the administrative area of the City of Peterborough.

APPLICATION OF THE DESIGNATION

5.  This designation applies to any house which is let or occupied under a tenancy or license within the area described in paragraph 4 which either:

A) i. is occupied by three or more persons;

 ii.  is occupied by persons living in two or more separate households; and  iii.  meets the standard test under section 254(2) of the Act; or the self-contained flat test under section 254(3) of the Act but is not a purpose-built flat situated in a block comprising three or more self-contained flats; or the converted building test under section 254(4) of the Act

B) meets the criteria under section 257 of the Act.

6.  The designation does not apply to any house which is let or occupied under a tenancy or license when

a.  the house is subject to an Interim or Final Management Order under Part 4 of the Act;

b. the house is subject to a temporary exemption under section 62 of the Act;

EFFECT OF THE DESIGNATION

7.  Subject to sub paragraph 6 (a) to (b) every house in the area specified in paragraph 4 and which falls within the description of a designated house in paragraph 5, that is occupied under a tenancy or license shall be required to be licensed under section 61 of the Act

8.  Peterborough City Council will comply with the notification requirements contained in section 61 of the Act and shall maintain a register of all houses registered under this designation, as required under section 232 of the Act

9.  Upon the Designation any person who operates a licensable property without a license is liable to prosecution and upon summary conviction liable to an unlimited fine. A person who breaches a condition of a license is liable to prosecution and upon summary conviction liable to a fine.

  All landlords, managing agents or tenants within the designated areas should obtain advice to ascertain whether their property is affected by the Designation at:
