CHELTENHAM BOROUGH COUNCIL (MARKETS) BILL
What is happening?
IN PURSUANCE of s.239 of the Local Government Act 1972 NOTICE IS HEREBY GIVEN that the meeting of the Cheltenham Borough Council ("the Council") to be held at the Municipal Offices, Promenade, GL50 9SA on 17/11/25 at 14:30 will take into consideration & determine upon the expediency of promoting a private bill in Parliament for effecting all or some of the following purposes, namely:
a) repealing s.83 of the Cheltenham Improvement Act 1852 (which prohibits market and related activities on the High Street or any other street in the borough);
b) applying Part III of the Food Act 1984 to any market in the borough; and
c) introducing a power for an authorised person to issue a fixed penalty notice to any person who the authorised person has reason to believe has committed an offence contrary to byelaws made under s.60 of the Food Act 1984. and for such other purposes as may be determined by the Council and also for the purpose (if deemed expedient to promote such a bill) of passing such resolutions as may be necessary or expedient in connection with the promotion of such a bill.
