NOTICE OF APPLICATION FOR AN ORDER AND FOR LISTED BUILDING CONSENT
The County Councilof the Cityand Countyof Cardiff (“theCouncil”) of County Hall, Atlantic Wharf, Cardiff, CF10 4UW has applied to the Welsh Ministers under section 6 of the Transport and Works Act1992for theabove-mentioned Orderunder sections1and5of that Act.
The Orderwouldauthorisetheconstruction,operation andmaintenanceofa newtramway in theCityofCardiff.Theproposed new tramwaywouldstartata new tramstopadjacent toCardiff Central Railway Station andrun alongTresillianWay, acrossCallaghan Square andthen followButeStreetbeforejoiningtheexistingrailwaybetween Queen Streetand Cardiff Bay Stations via a rampupfrom Bute Street near the junction of that road with North Church Street.
The Order also authorises the construction, operation and maintenance of a short section of tramroadandcertain stationworkswithin theexistingCardiff Bayrailcorridor between apoint near tothejunction of ButeStreetwith South Loudoun PlaceandCardiff BayStation.
The Order also makes amendments to the operating powers currently exercisable relatingtotheCardiff Bayrail corridor in relation totheoperation of tram carsover the Cardiff Bayrail corridorbyTransport forWales.
The Order wouldalso authorise the compulsory acquisition anduse of landrequiredin connection with theconstruction of the new tramway.
The Order would provide for the tram works to deviate within prescribed limits of deviation,theconstruction andmaintenanceofancillaryworkswithin Order limits, power totransfer thebenefitof theprovisionsof the Order,power toalter thelayoutof streets andmakeimprovementstothepublicrealmin Callaghan Square,powertokeepapparatus in streets and to execute street works, power to stop up streets permanently and temporarily, to provide access to works, to construct, alter and maintain new streets, provisions for the restoration of streets in the event the tramway is discontinued and agreements with streetauthorities.
The Order also makes provision for the discharge of water, in relation to works to safeguardbuildingsandtheoperation of thetramway, tosurveyandinvestigateland, toprovidefor the modeof construction andoperation of thetramway, in respectof the obstruction of the construction of the works,power to construct temporary tramways andtoremove human remains.
The Order modifies thetreatmentof landasoperational land,provides for thefellingor lopping of trees overhanging the works and overrides the application of landlord and tenant law in relation toagreementsabout the works.
The Order makes furtherprovision in respectof trespasson theproposedtramroadand makes provision for traffic regulation, provides a defence to proceedings in respect of statutory nuisance andincludesprotective, regulatory andancillaryprovisions,penalty faresandthepower to makebyelaws.
TheWelsh Ministers havedeterminedthat the application is not tobe made subject to an Environmental Impact Assessment.
Theapplication containsastatement thatadirection fordeemedplanningpermission is beingappliedfor.
Listed building consent is also required for the purposes of proposals included in the application forthe Orderandalistedbuildingconsentapplication isbeingmadein respect of the Grade II listedrailway overbridge (reference No. 13962) carryingthe Cardiff Bay Line Railwayover theunderpassbetween ButeStreetandLloyd George Avenue(E318699 N175754). The proposed works which are the subject of the application are works comprisingtheconstruction ofaramptocarrytheproposedtramwayformingWork No.1 in Schedule 1 to the Order from Bute Streetupto the existingCardiff Bay Line Railway affectingthesettingof thelistedrailwayoverbridge.
Under section 94of the HistoricEnvironment (Wales) Act2023theapplication for listed buildingconsent willbereferredtotheWelsh Ministers fordetermination.
A copy of the application, andall of theplans andotherdocuments submitted with it, and of the listed building consent application and allplans and documents submitted with itmaybeinspectedfreeof chargefrom 22 August2025until3 October2025at the followinglocationson thedaysandbetween thetimes specified–

• CentralLibrary Hub,The Hayes,Cardiff CF101FL, Monday,Tuesday,Friday & Saturdaybetween 9am and5pm, Wednesdaybetween 10am and6pm andThursdaybetween 10am and7pm (note: closedSundays).

Mae Cyngor Sir Dinas a Sir Caerdydd (“y Cyngor”) Neuadd y Sir, Glanfa’r Iwerydd, Caerdydd, CF10 4UW wedi gwneud cais i Weinidogion Cymru o dan adran 6 o Ddeddf Trafnidiaeth a Gweithfeydd 1992 am y Gorchymyn uchod o dan adrannau 1 a 5 o’r Ddeddf honno.
Byddai’r Gorchymyn yn awdurdodiadeiladu,gweithreduachynnal tramffordd newydd yn NinasCaerdydd. Byddai’rdramffordd newyddarfaethedigyn dechrau wrth arhosfan newyddger Gorsaf ReilfforddCaerdyddCanologacyn rhedegar hydFforddTresilian,ar draws Sgwâr Callaghan ac yna’n dilyn Stryd Bute cyn ymuno â’r rheilffordd bresennol rhwnggorsafoedd Heol y Frenhines a BaeCaerdydddrwy rampi fynyoStryd Buteger cyfforddy ffordd honnoâStryd OgleddolyrEglwys.
Mae’r Gorchymyn hefyd yn awdurdodi adeiladu, gweithredu a chynnal darn byr o dramffordd a gwaith gorsaf penodol yng nghoridor rheilffordd presennol Bae Caerdydd rhwng pwynt ger cyffordd Stryd Bute â Phlas Deheuol Loudoun a Gorsaf BaeCaerdydd.
Mae’r Gorchymyn hefydyn gwneuddiwygiadaui’rpweraugweithredusyddi’w harfer ar hyn obryd mewn perthynasâchoridor rheilffordd BaeCaerdydd mewn perthynasâ gweithreduceir tram drosgoridor rheilffordd BaeCaerdyddgan Trafnidiaeth Cymru. Byddai’r Gorchymyn hefyd yn awdurdodi caffael a defnyddio tir sy’n ofynnol mewn cysylltiadagadeiladu’rdramffordd newydd.
Byddai’r Gorchymyn yn darparu ar gyfer y gwaith tram i wyro o fewn terfynau rhagnodedigo wyriad,adeiladuachynnalgwaith ategolofewn terfynau’r Gorchymyn, pŵer idrosglwyddobudddarpariaethau’r Gorchymyn,pŵer i newidcynllun strydoedd a gwneud gwelliannau i’r tir cyhoeddus yn Sgwâr Callaghan, pŵer i gadw cyfarpar mewn strydoedd ac i wneud gwaith stryd, pŵer i gau strydoedd yn barhaol a dros dro, i ddarparu mynediad i waith, i adeiladu, newid a chynnal strydoedd newydd, darpariaethau ar gyfer adfer strydoedd pe bai’r dramffordd yn cael ei therfynu a chytundebaugydagawdurdodaustrydoedd.
Mae’r Gorchymyn hefydyn gwneuddarpariaeth argyfergollwngdŵr,mewn perthynas â gwaith i ddiogelu adeiladau a gweithredu’r dramffordd, i dirfesur ac ymchwilio i dir, i ddarparu ar gyfer y dull o adeiladu a gweithredu’r dramffordd, mewn perthynas â rhwystro adeiladu’r gwaith, pŵer i adeiladu tramffyrdd dros dro ac i symud gweddillion dynol.
Mae’r Gorchymyn yn addasu’rdriniaeth odir fel tirgweithredol,yn darparuargyfer torri neudociocoedsy’n bargodidrosygwaith acyn diystyrucymhwysocyfraith landlordiaid athenantiaid mewn perthynasâchytundebauynghylch ygwaith.
Mae’r Gorchymyn yn gwneud darpariaeth bellach mewn perthynas â thresmasu ar y dramfforddarfaethedigacyn gwneuddarpariaeth argyfer rheoleiddiotraffig,yn darparu amddiffyniadiachosionmewn perthynasâ niwsansstatudolacyn cynnwysdarpariaethau amddiffynnol, rheoleiddiolacatodol,prisiaucosba’rpŵer i wneudis-ddeddfau.
Mae Gweinidogion Cymru wedipenderfynu naddylidgwneudycaisyn ddarostyngedig i Asesiado’rEffaith Amgylcheddol.
Mae’r cais yn cynnwys datganiad sy’n nodi y ceisir cyfarwyddyd ar gyfer caniatâd cynlluniotybiedig.
