Notice Of Compulsory Acquisition Under Section 134(7) Of The Planning Act 2008

The Cambridge Waste Water Treatment Plant Relocation Order 2025 
Notice Of Authorisation Of Compulsory Acquisition

The above Order, made under the Planning Act 2008 by the Secretary of State for Environment, Food and Rural Affairs (“the Secretary of State”) and published on 8th April 2025, includes provisions authorising the compulsory acquisition of land, and of rights over land by creating new rights over it as well as by acquiring rights already in existence, as described in Schedule 1. 

The Order includes provision authorising the acquisition for the purpose of the construction, operation, protection and maintenance of the Cambridge Waste Water Treatment Plant Relocation Project (the “CWWTPRP”), which involves the construction of a new waste water treatment plant and sludge treatment centre together with the associated waste water and final effluent transfer infrastructure, comprising a waste water transfer tunnel from the existing Cambridge Waste Water Treatment Plant to the new waste water treatment plant, final effluent and storm pipeline with an outfall to the River Cam, and two new pipelines (rising mains) (the Waterbeach Pipeline) from the Waterbeach New Town development area off Bannold Drove (Waterbeach) to the new waste water treatment plant or to the existing Cambridge Waste Water Treatment Plant.

A person aggrieved by the Order may challenge the Order only in accordance with section 118 of the Planning Act 2008, which stipulates that any proceeding must be brought by filing a claim form for judicial review before the end of the period of 6 weeks beginning with the day after the day on which the Order was published (or, if later, the day on which the statement of reasons for making the Order is published).

Once the provision in the Order authorising compulsory acquisition comes into force Anglian Water Services Limited may acquire any of the land (including any existing rights and/or new rights) described in Schedule 1 below by executing a general vesting declaration under section 4 of the Compulsory Purchase (Vesting Declarations) Act 1981. A statement on the effect of Parts 2 and 3 of that Act is set out in Schedule 2.

Any person who would be entitled to claim compensation if a general vesting declaration were executed is invited to give information about the person’s name, address and interest in land, using the prescribed form, to Anglian Water Services Limited, care of Ian Cutts at Savills at: Unex House, 132-134 Hills Road, Cambridge, CB2 8PA or cwwtpr@savills.com. The prescribed form is set out in Schedule 3 below.

SCHEDULE 1
Description Of The Land, Existing Rights And The New Rights

The Order land is shown on the Land Plans and described in the Book of Reference (such terms are defined in Article 2 of the Order). Under the powers granted in the Order, Anglian Water Services Limited (being the undertaker as defined in Article 2 of the Order) may acquire compulsorily:

(a) so much of the Order land as is specified by Article 26 (compulsory acquisition of land) of the Order for the authorised development (as defined in Article 2 of the Order), or to facilitate it, or as is incidental to it; and

(b) such rights over the Order land, by creating them as well as by acquiring rights already in existence, or impose such restrictive covenants over the Order land, as is authorised by Article 28 (compulsory acquisition of rights and imposition of restrictive covenants) of the Order.

For land which is shown shaded blue or brown on the Land Plans, in which only new rights are to be acquired or restrictive covenants to be imposed, the purpose for which those new rights may be acquired and restrictive covenants may be imposed is described in Schedule 10 to the Order and includes:

(a) Waste Water Treatment Plant Permanent Access Rights
(b) Waterbeach Pipeline Permanent Access Rights
(c) Waterbeach Pipeline Rights
(d) Waterbeach Pipeline Restrictive Covenant
(e) Waterbeach Pipeline Permanent Drainage Rights
(f) Transfer Tunnel Restrictive Covenant
(g) Final Effluent and Storm Pipeline Rights
(h) Final Effluent and Storm Pipeline Restrictive Covenant
(i) Rising and Gravity Main Diversion Rights
(j) River Cam rights
(k) River Cam restrictive covenant
(l) Decommissioning Works Rights

Anglian Water Services Limited may also temporarily use the Order land to carry out the authorised development (as defined in Article 2 of the Order) pursuant to Article 35 of the Order and may temporarily use the Order land to maintain the authorised development pursuant to Article 36 of the Order.
