DESIGNATION OF AREAS FOR SELECTIVE LICENSING OF PRIVATELY RENTED PROPERTIES

HEREBY GIVES NOTICE of the designation under section 80 of the Act of the area described below as an area subject to Selective Licensing under Part 3 of the Act.

All that area of land in the Borough of Burnley known as Trinity and Gannow which includes the following:

  1. The Council of the Borough of Burnley, in exercise of its powers under Sections 80 to 84 of Housing Act 2004 and The Selective Licensing of Houses (additional conditions) (England) Order 2015 hereby designates part of the Trinity and Gannow with Daneshay wards within the County of Lancashire for the selective licensing of privately rented properties.

  2. The designation does not require confirmation by the Secretary of State as it falls under a general approval issued by the Secretary of State under s82 of the Act, namely The Housing Act 2004: Licensing of Houses in Multiple Occupation and Selective Licensing of Other Residential Accommodation (England) General Approval 2024 – GOV.UK (“the General Approval”).

  3. A copy of the designation and an accurate plan of the area covered are available for inspection at the Burnley Borough Council, Town Hall, Manchester Road, Burnley, BB11 9SA between the hours of 9am and 4.30pm Monday to Friday or via www.burnley.gov.uk/selectivelicensing

  4. The Council will comply with the notification requirements under Section 83 Housing Act 2004. The designation was made on 6th January 2025 and given approval and the designation will come into effect on the 27th April 2025. The designation shall cease to have effect on the 26th April 2030.

  5. The designation applies to any privately rented property that is let as a whole house in multiple occupation or single tenancy to a selective licensee and is occupied under a tenancy or a licence.

  6. Every landlord, person managing or tenant should seek advice from the Council as to whether their property is affected by the designation. Applications for a Selective Licence can be made from the 27th April 2025 at https://propertylicensing.burnley.gov.uk

  7. A person who fails to obtain a licence or a person who is required to be a licensee fails a criminal conviction with an offence under section 95 of the Act commits an offence that may result in the issuing of a Management Order in respect of the property and the making of a Rent Repayment Order in respect for the property.
