DESIGNATION OF AN AREA FOR ADDITIONAL LICENSING OF HOUSES IN MULTIPLE OCCUPATION SECTION 56, HOUSING ACT 2004
NOTICE OF DECLARATION

NOTICE IS HEREBY GIVEN in accordance with Section 59 of the Housing Act 2004 (‘The Act’) that Rochdale Borough Council in exercise of its powers under Section 56 of the Act made a designation on 28th January 2025.

The designation applies to all 3 and 4 person Houses in Multiple Occupation (‘HMOs’) in the whole of the Borough of Rochdale

CITATION, COMMENCEMENT AND DURATION

1. This designation may be cited as ‘The Rochdale Borough Council additional Licensing of HMOs Scheme’

2. This designation was made on 28th January 2025 and shall come into force on 28th April 2025

3. The designation shall cease to have effect on 28th April 2030 or earlier if the Council revokes the scheme under Section 60 of the Act.

The designation falls within a description of designations in relation to which the Secretary of State has given a general approval under Section 58 of the Act, namely The Housing Act 2004 : Licensing of House in Multiple occupation and Selective Licensing of Other Residential Accommodation (England) General Approval 2015.

APPLICATION OF THE DESIGNATION

Under the scheme, private landlords who rent out a 3 or 4 person HMO property in the borough of Rochdale, will be required to apply for a licence, subject to any statutory exemptions.

After the 29th April 2025, the consequences of failing to licence a property that is required to be licensed include, a criminal sanction of a fine or a civil penalty, having a rent repayment order, interim management order or final management order made against them.

The designation applies to the whole of the borough of Rochdale.

INSPECTION OF DOCUMENTS/APPLICATION FOR A LICENCE

The designation may be inspected at Rochdale Council Offices, Number One Riverside, Smith Street, Rochdale.

All landlords, managing agents and tenants should seek advice to find out if their property is affected by this designation.
