DESIGNATION OF AREAS FOR SELECTIVE LICENSING OF PRIVATELY RENTED PROPERTIES
HEREBY GIVES NOTICE of the designation under section 80 of the Act of the area described below as an area subject to Selective Licensing under Part 3 of the Act.
Description of the area to which the designation applies
– All that area of land in the Borough of Burnley known as the Queensgate area which includes the following:

The Council of the Borough of Burnley, in exercise of its powers under Sections 80 to 84 of Housing Act 2004 and The Selective Licensing of Houses (additional conditions) (England) Order 2015 hereby designates part of the Queensgate, Bank Hall, and Lane Head wards within the County of Lancashire for the selective licensing of privately rented properties.
The designation does not require confirmation by the Secretary of State as it falls under a general approval issued by the Secretary of State under S82 of the Act, namely The Housing Act 2004: Licensing of Houses in Multiple Occupation and Selective Licensing of Other Residential Accommodation (England) General Approval 2024 – GOV.UK (“the General Approval”).
A copy of the designation and an accurate plan of the designated area can be viewed free of charge at Burnley Borough Council, Town Hall, Manchester Road, Burnley, BB11 9SA between the hours of 9am and 4.30pm Monday to Friday or at www.burnley.gov.uk/selective-licensing/sl2024.
The Council made the designation on 27th January 2025 and gave approval that the designation will come into effect on 27th April 2025 and shall cease to have effect on 26th April 2030.
The designation applies to any privately rented property that is not a licensable house in multiple occupation or subject to any statutory exemption and is occupied under a tenancy or a licence.
Any landlord, person managing or tenant should seek advice from the Council as to whether their property is affected by the said designation. Applications for a Selective Licence can be made from the 27th April 2025 at https://propertylicensing.burnley.gov.uk.
The consequences of failing to licence a property which is required to be licensed are a criminal conviction with an unlimited fine, a civil penalty up to a maximum of £30,000, the making of a Management Order in respect of the property and the making of a Rent Repayment Order in respect of the property.
