INITIAL DEMOLITION NOTICE

Under Schedule 5A of the Housing Act 1985 (as amended)

This Notice is given by The Mayor & Burgesses of the London Borough of Newham, Newham Dockside, 1000 Dockside Road, London E16 2QU) ("the Council") and is served with the consent of the Secretary of State pursuant to paragraph 4(2) of Schedule 5A of the Housing Act 1985 given on 3 October 2024

1. The intention of the Council to demolish properties on the Canning Town and Custom House Estates, London E16:

The Council is required by Schedule 5A of the Housing Act 1985 to publish the following information:

The Council intends to demolish the following properties located on the Canning Town and Custom House Estates

Area 19:

  • 1-28 Normandy Terrace (inclusive), London E16 3AS
  • 64-80 Coolfin Road, London E16 3BE

Area 6:

  • 2-80 Ethel Rd, London E16 3AU
  • 37-75 Ethel Road, London E16 3AT
  • 82-178 Leslie Road, London E16 3AZ
  • 125A Throckmorton Road, London E16 3DN

Area 2A:

  • 1-36 Kennedy Cox House, London E16 1EU
  • Bothwell Close, London E16 1QS
  • 2-57 Forrat Acre Lane, London E16 1QT
  • Formunt Close, London E16 1QR
  • 2-7 Lawrence Street, London E16 1HG
  • 74-132 Lawrence Street, London E16 1HG
  • 1-93 Lawrence Street, London E16 1ER

("the Relevant Properties").

2. The demolition of the Relevant Properties is necessary for the implementation of the Canning Town and Custom House Estate Regeneration Programme.

3. The Council intends to demolish the Relevant Properties by 20 February 2028.

4. The Council has served initial demolition notices upon the tenants of the Relevant Properties. Those notices will remain in force until 20 February 2028 unless revoked or otherwise terminated under or by virtue of paragraph 3 of Schedule 5A of the Housing Act 1985.

5. This Initial Demolition Notice is given further to an initial demolition notice issued on 1 February 2018 and permission to do so has been granted by the Secretary of State under powers conferred by paragraph 4(2) of Schedule 5A of the Housing Act 1985.

6. Whilst this notice remains in force, the Council will be under no obligation to grant a right to buy as mentioned in section 138(1) of the Housing Act 1985 in respect of any claim to exercise the right to buy in respect of any of the Relevant Properties.

7. However, this notice does not prevent:

a) a claim by any of the Relevant Properties submitting a Right to Buy claim; or

b) the subsequent determination of whether any such claim to the Right to Buy complies with the Housing Act 1985 would otherwise have entitled the tenant to that claim; or

c) the service of a Final Demolition Notice in most circumstances where the notice is still in force.

8. Should the Council subsequently serve a Final Demolition Notice in respect of the Relevant Properties, the Right to Buy will cease to arise in respect of the Relevant Properties before this notice has expired.

9. Any person who has been granted a right to buy in respect of any of the Relevant Properties may be entitled to compensation under paragraph 138C of the Housing Act 1985 for legal and other expenses incurred in relation to the exercise of the existing right to buy claim in respect of any of the Relevant Properties.
