Housing Act 2004 Sections 80 - 84

DESIGNATION OF AREAS FOR SELECTIVE LICENSING OF PRIVATELY RENTED PROPERTIES

HEREBY GIVES NOTICE of the designation under section 80 of the Act of the area described below as an area subject to Selective Licensing under Part 3 of the Act.

Description of the area to which the designation applies

  • All that area of land in the Borough of Burnley known as the Padiham area, which includes the following:

Additional Information

  1. Legal Basis & Authority

    • The Council of the Borough of Burnley, in exercise of its powers under Sections 80 to 84 of the Housing Act 2004 and The Selective Licensing of Houses (Additional Conditions) (England) Order 2015, hereby designates part of the Gawthorpe and Hapton with Park wards within the County of Lancashire for the selective licensing of privately rented properties.
  2. Approval & Confirmation

    • The designation does not require confirmation by the Secretary of State as it falls under a general approval issued by the Secretary of State under 82 of the Act.
  3. Public Access to Documents

    • A copy of the designation and an accurate plan of the designated area can be viewed at:

      Burnley Borough Council, Town Hall, Manchester Road, Burnley, BB11 9SA, between 9 AM and 4:30 PM Monday to Friday or online at:

  4. Implementation Date

    • The Council made this designation on 22nd January 2025 and gave approval that the designation will come into effect on 27th April 2025.
  5. Scope of Application

    • The designation applies to privately rented property but not to a licensable house in multiple occupation (HMO) that is already subject to HMO licensing.
  6. Landlord Responsibilities

    • Every landlord, person managing, or tenant should check if their property is affected by the Selective Licensing designation.
    • Applications for Selective Licenses can be made from 27th April 2025 at:

      https://propertylicensing.burnley.gov.uk 

  7. Penalties for Non-Compliance

    • It is an offence to let a property without a Selective License if required.
    • A landlord may be subject to:

      • A criminal conviction
      • A Rent Repayment Order
      • Restrictions on property management
