Notice of intention to pass a Resolution on Street Trading and the designation of Consent, Licence and Prohibited Streets in the Borough

Notice is hereby given that at the full Council meeting of Runnymede Borough Council on 19 December 2024, a Resolution was passed under Para 2 Schedule 4 of the Local Government (Miscellaneous Provisions) Act 1982, to confirm current designations apart from The Broadway, New Haw, which shall be redesignated from a Consent Street to Prohibited Street.

The terms of the resolution are as follows:
1. that all previous Resolutions of the Council made pursuant to Paragraph 2 of Schedule 4 to the Local Government (Miscellaneous Provisions) Act 1982 (“the Act”) are hereby revoked;

2. that all streets maintainable at public expense, within the Borough of Runnymede, be designated as Prohibited Streets under Paragraph 2 of Schedule 4 of the Local Government (Miscellaneous Provisions) Act 1982, save the following which are to be designated as Licence Streets:

Licence Streets High Street, Egham Station Road North, Egham Guildford Street, Chertsey with effect from 10 February 2025

The effect of the resolution is that, from the said date, any person who engages in street trading in a Licence Street without being authorised to do so, or in any Prohibited Street, may be guilty of an offence and liable on summary conviction to a level 3 fine (not exceeding £1,000 at the date of this Resolution).

The proposed Resolution will allow the Borough Council to control street trading in these streets, using powers set out in the Act.

Any person who desires to question the validity of the Order or any provision contained in it on the grounds that it is not within the powers of the relevant sections of the Act of 1984 may within 6 weeks from the date on which the Order was made (such date mentioned above) make application for the purpose to the High Court.
