Notice of Confirmation of Public Path Order

Town and Country Planning Act 1990 Section 257 And Paragraph 7 of Schedule 14 The Cornwall Council Public Footpath No. 39 St Agnes (Part) (Land at Ropers Walk Farm, Mount Hawke) Public Path Diversion Order 2024

On 03 September 2024, Cornwall Council confirmed the above Order.

The effect of the Order, as confirmed, is to divert a part of Public Footpath No. 39 in the Parish of St Agnes commencing at its junction with a part of Public Footpath 39 St Agnes to be retained approximately 12 metres north-north-west of ‘Ropers Walk Farm’ at Ordnance Survey Grid Reference (OSGR) SW 71261 47627 and continuing in a generally west-south-westerly direction for a distance of 95 metres and terminating at its junction with another part of Public Footpath 39 St Agnes to be retained approximately 94 metres west-south-west of ‘Ropers Walk Farm’ at OSGR SW 71171 47596 to a revised line commencing at its junction with a part of Public Footpath Number 39 St Agnes to be retained approximately 12 metres north-northwest of ‘Ropers Walk Farm’ at OSGR SW 71261 47627 and continuing in a generally south-westerly then west-south-westerly direction for a distance of 108 metres and terminating at its junction with another part of Public Footpath 39 St Agnes to be retained approximately 101 metres west-south-west of ‘Ropers Walk Farm’ at OSGR SX 71171 47584.

A copy of the Order and the Order Map has also been placed and may be seen free of charge at St Agnes Library, Trelawney Road, St Agnes TR5 0TP between 09.30 and 12.30 and between 13.30 and 17.00 on Mondays; between 13.00 and 16.00 on Tuesdays; between 09.30 and 17.00 on Wednesdays; between 15.00 and 17.00 on Fridays; and between 10.00 and 13.00 on Saturdays (except Bank Holidays).

The order comes into force on the date on which Cornwall Council certify that the terms of Article 2 of the Order have been complied with, but if any person aggrieved by the order desires to question its validity or that any provision contained in it on the ground that that it is not within the powers of the above Act, or on the ground that any requirement of the Act has not been complied with in relation to the confirmation of the order, he or she may apply to the High Court for any of these purposes under section 287 of the Town and Country Planning Act 1990 within six weeks from the date on which notice is first published as required by paragraph 7 of Schedule 14 to the Act.
