What is happening?

NOTICE OF CONFIRMATION OF MODIFICATION ORDER SECTION 53 OF THE WILDLIFE AND COUNTRYSIDE ACT 1981
STAFFORDSHIRE COUNTY COUNCIL
DEFINITIVE MAP AND STATEMENT FOR PUBLIC RIGHTS OF WAY IN THE STAFFORDSHIRE MOORLANDS DISTRICT

Staffordshire County Council (Upgrade of Public Footpath No. 60 Waterhouses Parish to a Restricted Byway) Modification Order 2024

On the 30th July 2024 Staffordshire County Council confirmed the above Order made under section 53 of the Wildlife and Countryside Act 1981. 

The effect of the Order as confirmed, is to modify the Definitive Map and Statement for the area by upgrading of the entire length of the existing public footpath known as Waterhouses 60 to a restricted byway, commencing at point A on the map (NGR 406480, 349219), at the corner on the unclassified public road known as Dukes Lane, Windy Harbour. Then running in a generally north-north westerly direction for approximately 670 metres to the unclassified public road known as Tatlers Lane, Windy Harbour, point B on the map, (NGR 406196, 349795). The modification specified that the width of the restricted byway shall be 3 meters. 

A copy of the confirmed Order and Map has been deposited and may be seen free of charge at the office of Staffordshire Moorlands District Council, Moorlands House, Stockwell Street, Leek, ST13 6HQ during normal working hours and at Staffordshire County Council Reception, Staffordshire Place 1, Tipping Street, Stafford, ST16 2LP during normal working hours, Mondays to Fridays. Copies of the Order and the Map may be purchased.

The Order came in to force on the 30th July 2024, but if a person aggrieved by the Order wishes to question its validity, or any provision contained within it on the ground that it is not within the powers of the Wildlife and Countryside Act 1981 or on the ground that any requirement of the Act or of any Regulation made under the Act has not been complied with in relation to the Order, they may, under paragraph 21 of Schedule 15 to the Act within 42 days from the 11th September 2024 make an application to the High Court.
